한․중 검찰제도 비교 연구 (A Comparative Study on the Prosecution Systems of the Republic of Korea and the People'sRepublic of China)

초록

삼권분립을 원칙으로 하는 우리나라에서 검찰권은 행정기관에 속하는 반면 중국은 검찰권의 준사법성을 특히 강조하여 “준사법기관”이라 불리고 있다.
그러나 중국은 우리나라와 다른 권력집중적 구조인 인민대표대회제도라는 정치제도를 가지고 있다.
인민대표대회는 전체 국가기구체계에 있어서 지배적인 지위를 가지고 있고, 국가행정기관과 심판기관 및 검찰기관은 모두 인민대표대회가 구성하고 이들 기관들은 인민대표대회에 책임을 지며 감독을 받는다. 인민대표대회 아래에 국가행정기관과 심판기관 및 검찰기관을 독립적으로 설치하고, 이들 기관이 행정권, 심판권, 법률감독권을 각각 행사하게 한다.
즉, 검찰기관은 인민대표대회에는 종속되지만 국가 행정기관과 심판기관과는 병렬적인 국가기관으로 독립적인 법률적 지위를 가진다.
이에 대해 우리나라의 검찰은 국가권력분립의 원칙에 따라 조직상으로는 행정부에 속하지만, 범죄수사와 공소제기·유지 및 재판의 집행을 내용으로 한다는 점에서 사법기관으로서의 특성도 지니고 있다.
중국 검찰제도는 중국 법률문화의 특징을 반영하고 있는 독특한 제도이기 때문에 검찰제도의 역사적 발전과정과 특징을 알아보는 것은 중국 검찰제도의역사적 필연성과 현실적 합리성을 이해하는데 그 의의가 있다. 따라서 이 글에서는 한국과 중국의 검찰제도의 발전과정, 근대이전의 검찰제도, 근대적 검찰제도 및 현행 검찰제도의 발전과정을 살펴보고, 다음으로 한국과 중국의 검찰권제도상 검찰구조와 조직 및 검찰의 특성을 중심으로 비교·고찰하였다.

영어초록

The prosecutor’s authority in our country observing the principle of the separation of powers is an administrative agency while that in China is called as a “quasi-judical agency” by emphasizing its quasi-judicial authority especially. However, China has a political system, so called, the National People’s Congress as a power-centered system unlike our system.
The National People’s Congress has a dominating position over the total structure of the national agencies. The Chinese national administrative, judicial and prosecution agencies are structured and superintended by the National People’s Congress and the Congress is responsible for those agencies. The national administrative, judical and prosecution agencies are established independently from each other under the National People’s Congress and each agency can exercise the administrative, judicial and legal superintendent powers respectively. That is, the prosecution agency is subordinated to the National People’s Congress, but it has a legal position as a parallel national agency independent from the national administrative and judicial agencies.
On the other hand, our country’s prosecution has some characteristics also as a judicial agency considered the fact that the agency has the rights to investigate a crime, prosecute & maintain a case and execute a trial although the prosecution belongs to the Administration from the aspect of its structure according to the principle of the separation of powers.
Since the prosecution system of China is a unique system representing the characteristics of the Chinese legal culture, to review the historical development process and characteristics of the prosecution system is meaningful to understand the historical necessity and realistic rationality of the Chinese prosecution system. Therefore, in this thesis, the development process of each prosecution system of South Korea and China and the development processes of the prosecution system before the modern era, the modernistic prosecution system and the current prosecution system shall be examined. And then, those development processes were compared and reviewed focusing on the prosecution structure and organization, the characteristics of the prosecution in both countries.
