중소기업관련법과 정책의 개선 (Reformation of Small & Medium Enterprise Related Laws and Policies)

초록

우리나라에서는 중소기업이 그 수가 매우 많을 뿐만 아니라 고용에 있어서 차지하는 비중도 아주 크고 부가가치 등에 있어서 기여하는 비중도 크기 때문에 국민경제에서 차지하는 비중이 매우 크다. 그러나 중소기업은 자금, 인력, 기술, 판로, 경영,정보, 교섭력 등의 측면에서 대기업에 비하여 열악한 처지에 놓여 있을 뿐만 아니라대기업의 불공정한 거래관행으로 인한 피해를 받고 있기 때문에, 국민경제의 지속적인 성장과 발전을 주도하는 경제주체로서의 역할을 제대로 수행하지 못하고 오히려국민경제의 균형 있는 발전을 저해하는 장애요인으로 작용하고 있다. 이에 정부는1980년대부터 국민경제의 지속적인 성장과 균형 있는 발전을 도모하기 위하여 중소기업을 보호하고 지원․육성하기 위한 법과 정책을 마련하여 실시하고 있지만, 중소기업이 국민경제에서 차지하는 지위나 역할은 아직 획기적으로 개선되지 않고 있다.
그 이유는 크게 두 가지로 나누어진다. 우선, 일차적으로는 중소기업관련법과 정책이 소기의 성과를 거두지 못하고 있기 때문이다. 그리고 보다 근본적인 이유는 대기업 중심적인 경제구조가 대기업과 중소기업을 포함한 모든 경제주체가 함께 성장․발전해 나갈 수 있는 다원적인 경제구조로 바뀌지 않고 있기 때문이다. 따라서중소기업이 대기업과 함께 국민경제의 지속적인 성장과 균형 있는 발전을 주도해나가는 경제주체로 성장․발전해 나갈 수 있도록 하기 위해서는 중소기업관련 법과정책을 전면적으로 개편할 필요가 있다. 우선, 단기적으로는 중소기업의 상대적인취약점을 제거하기 위한 고유한 의미의 중소기업관련법과 대기업의 불공정한 거래관행을 시정함으로써 중소기업을 보호하기 위한 기능적인 의미의 중소기업관련법의실효성을 제고함으로써, 중소기업의 건전한 발전과 경쟁력 향상을 위하여 노력할 필요가 있다. 그리고 장기적으로는 대기업 중심적인 경제구조를 대기업과 중소기업이함께 성장․발전해 나갈 수 있는 다원적인 경제구조로 전환하여, 대기업과 중소기업이 각각 그들의 장점을 살려서 가격과 품질 등과 같은 장점(merits)을 중심으로공정하게 경쟁할 수 있게 함으로써 중소기업이 대기업과 함께 국민경제의 지속적인 성장과 균형 있는 발전을 주도해 나가는 경제주체로 발돋움할 수 있는 환경과 여건을 조성하기 위하여 노력할 필요가 있다.
그런데 대기업 중심적인 경제구조를 대기업과 중소기업이 동반성장할 수 있는 다원적인 경제구조로 전환하기 위해서는 소수의 재벌에게 과도하게 집중되어 있는 경제력집중을 완화하는 동시에 독과점적 시장구조가 장기간 고착화되어 있는 산업분야의 시장구조를 경쟁적인 구조로 개혁할 필요가 있는데, 이러한 과제는 고유한 의미의 중소기업관련법과 정책의 집행을 담당하고 있는 중소기업청의 차원에서 해결할 수 있는 범위를 넘어서는 대단히 중요하고 어려운 국가적인 과제라고 할 수 있다. 따라서 앞으로는 중소기업관련법과 정책의 집행을 단순히 중소기업청이나 산업통상자원부의 차원에 맡겨 놓을 것이 아니라, 국민경제의 지속적인 성장과 균형 있는 발전을 도모할 수 있는 경제환경이나 시장구조를 형성하기 위한 국가경제의 장기적인 발전전략의 문제로 보아, 이를 국가적인 차원에서 종합적으로 추진해 나가도록 노력할 필요가 있다.

영어초록

SMEs make up large portion of the national economy in Korea. Their number,employment capacity and value added constitute a large share of the Koreaneconomy. However, SMEs are struggling to perform their role as a major economicplayer and regarded as deterrents when it comes to considering a balanceddevelopment of the national economy due to their relatively weak position comparedto large enterprises in considering their available funds, human resources,technologies, marketing channels, and bargaining power etc.
Notwithstanding the governmental policies and laws introduced since 1980 withthe aim of protecting, supporting, and promoting SMEs, the position and role ofSMEs have not been improved substantially in our national economy.
There are two primary reasons for the SME’s current problems in the Koreannational economy. Firstly, the implementation of SMEs related laws and policieshave not been fully effective. Another reason for their unsatisfactory outcome is areflection of the underlying economic structure of Korea favoring large business,preventing the SME related laws and policies to operate properly. Thus, an overallpolicy and legislative reform is called for in order that both SMEs and large businessesoperate as viable economic entities contributing to the sustainable growthand well-balanced development of the national economy.
In order to mitigate or eliminate the SMEs’ relative weakness in the economyand to promote the healthy growth and competitiveness of SMEs, it is necessaryto rectify the SME related laws and the established unfair practices by large businesses and to enhance the effectiveness of the functional aspects of the SME relatedlaws. Moreover, a long term strategic approach to this problem would be tocreate a favorable business environment for SMEs in which both large businessesand SMEs can compete more fairly on their merits and cooperate more closely inthe market.
In the light of the current large business oriented economic structure, however,there is a call for the de-concentration of economic power by large conglomeratesas well as the reform of the long-standing monopolistic or oligopolistic marketstructures for certain industries for the purpose of transforming our economy intothe more pluralistic economic structure. Accordingly, making such a transformationis outside the scope of the Small and Medium Enterprise Administration’s (SMEA)competence that should be taken up seriously at a national level. For that reason,the future SME policy should not just be left in the hands of the SMEA and/orthe Ministry of Trade, Industry & Energy, both of which primarily focus on protectingand supporting SMEs as a weaker economic entity. The SMEs related lawsand policies should be considered as a part of the long-term national strategyaimed at establishing the economic structure suitable for the sustainable growth andwell-balanced development.
