초록

지금까지 공무원법의 역사에 대한 연구는 거의 없었다. 이 논문에서는 공무원관계법령 중 가장 기본이 되고 중요한 헌법, 국가공무원법, 노동조합관계법의 변천을 중심으로 한국공무원법의 역사를 고찰하기로 한다.
한국의 공무원법은 정치·사회의 변화에 따라 발전하였다. 법치주의의 발전에 따라 특별권력관계이론이 부정되고, 공무원관계의 법정화가 강화되었다. 다른 한편으로 공무원관계의 일반 근로관계와의 구별이 완화되고, 공무원조직의 ‘국민 전체에 대한 봉사자’로서의 지위, 효율성 등 공무원조직의 새로운 가치가 법제화되고 있다.
법이론상 특별권력관계이론은 사망선고를 받았지만, 아직도 실제에 있어서는 공무원관계에서 특별권력관계의 그림자가 완전히 걷혔다고 보기는 어렵다. 앞으로 기존의 공무원법 중 특별권력관계의 그림자를 지우고 공무원의 근무관계법을 법치주의에 합당하게 정비하는 노력이 필요하다.
최초의 국가공무원법 이래 공무원의 ‘국민 전체의 봉사자’로서의 지위가 규정되어 오고 있다. 그런데, 공무원의 국민 전체에 대한 봉사자로서의 지위는 추상적인 모호한 개념이다. 공무원의 국민 전체에 대한 봉사자로서의 지위의 현대적･법적 의미를 재정립하여야 한다.
2005. 1. 27. 공무원의 노동조합 설립 및 운영등에 관한 법률(약칭: 공무원노조법)이 제정되어 제한된 범위에서 공무원의 노동운동이 허용되었다. 노동운동을 공무외의 집단적 행위의 하나로 규정하는 것은 타당하지 않고, 노동운동과 공무외의 집단적 행위의 규율을 나누어야 한다.
1960. 6. 15. 헌법 개정에서 직업공무원제도가 규정되었다. 그 후 직업공무원제도는 공무원법의 핵심적인 내용이 되었다. 공무원조직의 폐쇄성, 행정개혁에 대한 저항 등 직업공무원제의 폐해를 시정하기 위한 제도의 개선도 있었다. 그렇지만, 다른 한편으로 공직기강의 확립이나 공무원에 대한 민주적 통제의 이름하에정치권력이 공무원조직을 장악하려는 시도도 있었다. 고위공무원단제도는 고위공무원 인사운영에서의 융통성을 높일 수 있지만, 직업공무원제도를 약화시킬 수도 있다. 신공공관리론은 행정과 기업경영간의 구별을 완화하는 역할을 수행하였고, 행정의 효율성의 가치를 높이는 결과도 가져왔지만, 행정의 공공성, 공무원의 윤리성을 경시하는 풍조도 형성하였다. 직업공무원제도는 공무원의 신분이 보장될 뿐만 아니라 공무원의 전문성과 윤리성이 갖추어져야 제 기능을 발휘할 수 있다.
한국공무원법은 변화의 한가운데 있다. 바람직한 공무원제도의 재정립을 위한 연구가 많이 행해져야 할 것이다.

영어초록

To this day, there have been very few studies on the korean history of civil service law. This article aims to examine the history of the korean civil service laws, focusing on the changes in the Constitution of the Republic of Korea, the State Public Officials Act, and the Act on the Establishment and Operation, etc., of Public Officials' Trade Unions.
The civil service laws in Korea have been developed in response to changes in politics and society. With the development of the rule of law, the theory of special authority relationship(besonderes Gewaltverheltnis) was denied and the legalization of civil servant relationship was strengthened. On the other hand, the distinction between civil servant relationship and general labor relationship has been relaxed, and new values of civil servant organizations such as the status and efficiency of civil servant organizations as ‘servants for the whole nation’ are being legislated. In legal theory, the theory of special authority relationship was declared dead, but in practice. But, it is difficult to think that the shadow of special authority relationship has been completely lifted from public officials. It takes an effort in the future, to erase the shadow of special authority relationship in the existing civil service laws and to reorganize the civil servants' work relations laws to comply with the rule of law.
Since the first enactment of the State Public Officials Act, the status of public officials has been defined as ‘servants of the whole nation’. However, the concept of ‘status of public officials as volunteers for the entire nation’ is abstract and vague. It is necessary to redefine the modern and legal meaning of the status of public officials as volunteers to the entire nation. On January 27, 2005, the Act on the Establishment and Operation, etc., of Public Officials' Trade Unions(the abbreviation: Public Officials' Union Act) has been published, and has allowed public officials' labor movement to a limited extent. It is not justified to define the labor movement as one of the collective actions outside of official duties, but the labor movement must be divided into the discipline of the labor movement and the discipline of collective actions outside of official duties.
In the amendment of the Constitution(June 15, 1960), the career civil service system was stipulated. After that, the vocational civil service system became the core content of the civil service law. There were also improvements in the system to correct the negative effects of the career civil service system, such as the disposition towards closur of the civil service organization and resistance to administrative reform. However, on the other hand, there were also attempts by political power to take over the public service organization in the name of tightening discipline among government officials or controling democratically over civil servants. The senior executive services system can increase flexibility in the personnel management of senior civil servants, but it can also weaken the professional civil service system. The New Public Management theory played a role in easing the distinction between administration and corporate management, and resulted in increasing the value of administrative efficiency, but also formed a trend of downplaying public administration and the ethics of public officials. The career civil service system guarantees the status of public officials, and it can only function properly when the public officials have professionalism and ethics.
The korean civil service laws are in the midst of a change. A lot of research needs to be done for the re-establishment of a desirable civil service system.
