청소년 기본법상 청소년 문제에 대한 해결방안 제고 (Improvement of Solutions on Youth Problems Under Framework Act on Juveniles)

초록

청소년이란 나라의 든든한 미래이므로 그들의 성장과 발전에 도움이 되도록 하여야 한다. 따라서 청소년에 대한 가정과 사회 및 국가의 책임이 수반되어야 하며 또 이에 따른 지원도 아끼지 말아야 한다.
그런데 오늘날 청소년들에게 있어서 문제가 되는 것은 사회적으로 청소년들의 건강한 성장에 유해한 물질・물건・장소・행위 등 각종 유해 환경에 둘러싸여 있는 환경에 기인되고 있으며, 이러한 결과로 청소년들의 자살, 학교폭력이나 가출, 유해약물, 유해업소, 학대 등 부정적인 청소년 문제가 사회의 중요한 쟁점이 되고 있다.
특히 청소년에 대한 법적 문제로서 청소년 기본법상 청소년 개념의 혼란, 청소년 자신의 책임, 청소년에 대한 가정의 책임, 청소년에 대한 사회의 책임, 청소년에 대한 국가의 책임 등이 문제가 되고 있다. 우선, 청소년 기본법상 청소년에 대한 개념이 불확실하다. 청소년의 연령이 법적으로 각각 달리 규정하고 있어서 혼란이 제기되고 있다. 그리고 청소년의 문제가 날로 심화되고 사회적인 문제로 대두되면서 위기 청소년의 수가 매년 증가하고 복잡한 양상을 띠고 있다. 또 가정에서 자녀에 대한 무관심과 방임 또는 학대 등으로 인하여 자살, 폭력, 가출, 유해환경 접촉 등이 문제가 되고 있다. 아울러 현대 사회의 문제화로 인하여 청소년에게 악영향을 끼치고 있다. 입시 경쟁, 취업 지연, 청소년 범죄, 환경오염, 나쁜 건강 상태 등이 문제가 되고 있다. 그 밖에 정부의 청소년 정책의 체계성과 일관성 부족, 청소년 육성・지원 추진체계 부진 등이 문제되고 있다.
이에 대하여 청소년 기본법상 청소년 개념의 통일화, 청소년의 권리에 따른 의무의 충실화, 가정에서의 자녀 교육과 지도의 충실화, 청소년에 대한 사회적 지도의 충실화, 국가의 청소년 정책 강화 등이 요망된다. 우선 청소년의 민주적인 가치관 정립과 지도력 강화를 위해서 인성과 전문지식의 함양, 건강과 봉사정신 강화, 문화적 정체성 확립 등이 중요하다. 그리고 가정에서는 자녀에 대한 사랑과 관심으로 지도하며 개성과 자아실현에 힘써야 한다. 그러기 위해서는 부모는 자녀와 진솔한 관계형성, 자녀에 대한 수용과 존중, 엄격함과 자애로움의 균형, 토론・조언・충고의 제공자가 되어야 한다. 또 사회에서는 청소년들에게 유해환경의 사전방지와 경제적・사회적・문화적・정신적으로 어려운 환경에 있는 청소년들에게 도움을 주어야 한다. 아울러 국가의 청소년 정책에 있어서는 미래 청소년을 위한 법적・제도적 장치마련과 보다 장기적이고 체계적이며 일관성 있는 정책의 수립・시행이 필요하다.
이상 청소년 지도에 있어서 구체적인 실천방안으로서 청소년 기본법상 청소년 개념에 대한 통일화를 위한 입법적 보완, 청소년 자신과 가정・사회・국가 등의 책임 강화, 그리고 청소년 문제가 발생하지 않도록 사전방지 제도와 권리에 따른 의무가 수반되도록 해야 할 것이다.

영어초록

The youth are the dependable future of the country, so we must contribute to their growth and development. Therefore, responsibilities of the family, society and the nation to the youth have to be accompanied, and we should not spare any effort according to premise.
What have become problems to the youth these days results from the various noxious environments surrounding them such as the material, items, places and acts harmful to their healthy growth and as a result, negative youth problems such as suicide, school violence, runaway, dangerous drugs, harmful businesses, abuse, etc. have become important issues in society.
In particular, confusion on the concept of youth under the Framework Act on Juveniles, responsibility of the youth themselves, the family’s responsibility to the youth, the society’s responsibility to the youth, and the nation’s responsibility to the youth have become problematic as the legal issues for the youth. First, the idea on the youth is unclear according to the Framework Act on Juveniles. The age of the youth is defined differently under different laws, which causes confusion. And as youth problems become aggravated and significant as a social problem, the number of youth in crisis increase every year and the issue is becoming more complex. In addition, suicide, violence, runaway and contact with harmful environment have become a problem due to indifference, neglect or abuse at home. Also, the problems of the modern society are having a negative impact on the youth. Competition in college admission, delays in finding employment, juvenile crimes, environmental pollution, bad health, etc. have become problematic. In addition, the lack of systematic and consistency in the youth policy of the government, poor promotion system of fostering and support of the youth have been pointed out as the problems.
For these issues, harmonization of the concept of the youth under the Framework Act on Juveniles, faithfulness to the duties to the rights of the youth, devoted education and guidance on the youth at home, devoted social guidance on the youth and strengthening the youth policy on the national level are required. First, it is important to cultivate good characters and professional expertise, strengthen health and service spirit and establish a cultural identity. At home, we need to guide the youth with love and concern on children and strive for them to realize their individuality and self. In order to achieve these goals. we need to form a honest relationship between parents and children, accept and respect children, maintain a balance between austerity and benevolence, and become a provider of discussions, advices and counseling. Also, the society in general must prevent environment harmful to the youth in advance and help the youth in difficult situations economically, socially, culturally and psychologically. In addition, we need to provide legal and systematic measures for the future youth and establish and implement more long-term, systematic and consistent policies.
As the detailed action plans for youth guidance, we need complementary legislations for the unification of the concept of youth under the Framework Act of Juveniles, to strengthen the responsibility of the youth themselves, family, society and the nation, and to ensure that the preventive measures to ensure youth problems do not occur and responsibilities to their rights are accompanied.
