국민주권과 정당 (National sovereignty and Political parties)

초록

현행 대한민국 헌법 제8조에 따르면 정당은 어 있는 정당조항은 정당에 대해 설립의 자유를 보장하고 있으며(헌법 제8조 제1항), 민주적 정당제(헌법 제8조 제2항, 제4항)에 대한 정당 스스로의 책무 및 정당에 대한 국가보호(헌법 제8조 제3항)를 규정하고 있다. 우리 헌법재판소 헌재결, 1989. 9. 8, 88 헌가 6 는 실질적 국민주권에 대해 국민이 실제 현실적으로 국가최고의사를 결정함으로써 이루어지는 실질적 생활용 국민주권으로서, 이는 현대 서구민주국가 주권론으로서, 구시대의 권력독점적 순수대표제를 변모시켜 민의의 실제반영과 국민을 실질적 주인으로 하는 “현대적 국민대표제”를 발전시켜 온 것으로 보고 있다. 이런 관점에서 본다면 정당제도는 정당국가적 민주주의라는 프레임이 아니라, 그것이 민주국가 형성에 기여하는 정도인 민주적 정당제도라는 관점에서 보아야 할 것이다.
그러나 현행 정당법상 정당등록 및 취소제도의 경우 과도한 정당설립요건을 규정하여 정당의 활발한 정치참여를 어렵게 하고 있을 뿐만 아니라, 과도한 법정요건을 통해 사실상의 강제해산과 다름없는 효과를 가져오고 있기 때문에 헌법이 추구하고자 하는 정당의 자유로운 정치활동의 보장이라는 목표와 상충된다. 또한 정치자금법상 국고보조금제도 역시 의석수와 총선득표율을 중심으로 배분되기 때문에 실질적 국민의사를 반영하지 못한다는 비판이 제기될 뿐만 아니라, 그 금액 또한 상한에 대한 제한이 없이 지속적으로 상승하는 구조로 규정되어 있어 정당의 자립력을 저하시키는 요인이 되고 있다. 이처럼 정당의 기능을 제약하는 요소가 정당 관련 법률 내부에 자리잡고 있는 상태에서는 정당을 통한 국민주권의 이상은 구현되기 어려울 것이다. 따라서 국민의 의사가 정당을 통해 올바르게 투영되어 정당이 제기능을 수행할 수 있도록 관련 정당법 및 정치자금법 개정에 관한 폭넓은 논의와 개정작업이 뒤따라야 할 것이다.

영어초록

According to Article 8 of the current Korean Constitution, the party provision ensures the freedom of establishment for a political party (Article 8 Paragraph 1 of Constitution) and stipulates the responsibilities of the party itself for the democratic party system(Article 8 Paragraph 2, Paragraph 4 of Constitution) and national protection for political parties (Article 8 Paragraph 3 of Constitution). Our Constitutional Court Constitutional Court decision, 1989. 9. 8, 88 Heonga 6 regards substantial popular sovereignty as substantial life popular sovereignty made by the people by making the nation's top decisions actually and realistically and this is the modern Western democratic country sovereignty theory and has developed a “modern national representative system” by transforming power monopolistic pure representative system of the old days to actually reflect the will of the people and considering the people to be substantial owners. From this standpoint, a party system should be seen in terms of the democratic party system, the extent it contributes to the formation of a democratic country rather than the frame of the party national democracy. However, party registration and cancelation system in accordance with the current Political Party Law not only make it difficult for political parties to actively participate in politics by prescribing excessive political party establishment requirements but conflict with the objective of ensuring free political activities of political parties pursued by the Constitution because excessive legal requirements cause the effect not different from actual compulsory winding-up. Also, since government subsidies in accordance with the Political Fund Law are also distributed around the general election vote rate and number of seats, the criticism of not reflecting substantial national intention is raised and the amount is also defined as a structure of rising continuously without the restriction on the upper limit and becomes a factor that degrades the self-reliance of political parties. As shown above, as long as the elements that limit the function of political parties are settled inside the party related law, the ideal of popular sovereignty through political parties will be difficult to implemented. Therefore, broad discussions and revision about the amendment of related the Political Party Law and Political Fund Law should be followed so that the will of the people can be projected correctly through political parties and the parties can perform their functions
