소년조사제도의 문제점과 개선방안 (Problems of and Improvement Plans for Juvenile Investigation System)

초록

소년법은 반사회성이 있는 소년의 환경 조정과 품행 교정을 위한 보호처분 등의 필요한 조치를 통하여 궁극적으로는 소년의 건전한 성장에 이바지하고자 한다. 여기서보호처분 등의 필요한 조치를 부과하기 위해서는 우선적으로 소년의 환경이나 품행에 대한 실질적인 파악을 통하여 반사회성의 여부에 대한 판단이 선행되어야 하는데, 이를 위하여 소년사법절차에서는 각 단계별로 다양한 소년조사제도를 활용하고있다. 경찰단계에서는 조사과정에서의 전문가참여제도를 통하여 비행성예측자료표및 소년환경조사서를 활용하고 있으며, 검찰단계에서는 보호관찰소의 장, 소년분류심사원장, 소년원장 또는 청소년비행예방센터장에게 소년의 품행․경력․생활환경․요보호성 등에 관한 조사를 요구할 수 있는 검사 결정전조사제도가 도입된 바 있다. 다음으로 법원단계에서는 보호사건에서의 소년조사제도와 형사사건에서의 소년조사제도로 나누어 살펴 볼 수 있는데, 전자의 경우에는 가정법원 또는 지방법원 소년부의 조사명령에 의한 조사관조사와 전문가의 진단, 소년분류심사원의 분류심사 결과와 의견, 보호관찰소의 조사결과와 의견 등을 고려하는 결정전조사가 활용되고 있으며, 후자의 경우에는 역시 조사관조사와 유죄가 인정된 소년피고인에 대하여 조사를요구할 수 있는 판결전조사가 각각 활용되고 있다. 마지막으로 교정단계에서의 소년조사제도로는 분류처우심사, 환경조사, 분류심사 등이 시행되고 있다.
이와 같이 현행 소년조사제도는 경찰단계에서부터 교정단계에 이르기까지 다양한유형과 방식으로 진행되고 있는데, 소년의 환경과 품행을 실질적으로 조사하여 이에적합한 개별적인 처우를 함에 도움을 주고자 하는 궁극의 목적은 동일하다. 하지만유사한 내용에 대하여 각 기관별로 새롭게 조사를 의뢰함에 따른 중복조사의 문제, 숙련된 조사인력이 턱없이 부족하여 발생하는 조사과정의 내실화 내지 전문성의 문제, 모든 유형에 있어서 소년조사의 실시 여부가 필요성의 판단에 따른 임의적인 사항에서 발생하는 재량판단의 문제 등은 문제점으로 지적되고 있다. 이러한 상황인식을바탕으로 본고에서는 소년조사제도의 각 단계별 현황 및 실시과정에서 발생하고 있는 문제점을 분석한 다음 이에 대한 합리적인 개선방안을 제시해 보기로 한다.

영어초록

The juvenile act intends to contribute to sound growth of juvenile ultimately through necessary measures such as regulation of environment and correction of conduct for juvenile with antisociality.
For doing so, judgment of antisociality shall be preceded preferentially through actual understanding of environment or conduct of the juvenile to impose necessary measures such as protective disposition etc., and fore the aforementioned, juvenile justice procedure uses various juvenile investigation systems for each stage. Police stages use delinquency forecast data sheet and juvenile environment investigation report through expert participation system in the process of investigation, and in the stage of prosecution, prosecutor pre-determination investigation system has been adopted to request the director of probation office, juvenile classification review center, juvenile reformatory or juvenile delinquency prevention center for investigation of conduct․career․ living environment․necessity of protection of juvenile. In the stage of court, it can be examined by dividing into juvenile investigation system in protection cases and the one in criminal cases, and investigation of investigator and diagnosis of expert, classification result and opinion from the juvenile classification review center and pre-determination investigation to consider investigation result and opinion of probation office are used for the former, and investigation of investigator and pre-judgment investigation to request investigation of convicted juvenile defendants are applied respectively for the latter. Lastly, classification treatment review, environment investigation and classification review have been implemented as juvenile investigation systems in the stage of correction.
Presently, juvenile investigation system has been implemented in various types and methods from the stage of police to the stage of correction, but the ultimate intentions to make a practical investigation into the environment and conduct of juveniles and provide help to individual treatment suited to the result are the same.
However, duplicate investigation caused by request for new investigation of similar matters from each institute, issue of substantialization or expertise in the process of investigation caused by vastly insufficient skilled manpower for investigation, and discretionary decision for implementation of investigation of juvenile in all cases have been pointed out as problems. This manuscript aims to suggest rational improvement plans for the present juvenile investigation system after analyzing the present status of juvenile investigation system in each stage and problems generated in the course of implementation.
