헌법 제31조 제4항의 해석과 적용 (Interpretation and application of Article 31(4) of the Constitution)

초록

현행 헌법 제31조 4항은 “교육의 자주성･전문성･정치적 중립성 및 대학의 자율성은 법률이 정하는 바에 의하여 보장된다”라고 규정하고 있다. 헌법은 제31조 4항에서 규정하고 있는 “교육의 자주성･전문성･정치적 중립성 및 대학의 자율성”이 구체적으로 무엇을 의미하는지 그 내용과 범위 등에 대해서는 정립된 이론도 미진한 편이며 이 조항의 적용을 통한 구체적인 사례의 판례 또한 많이 축적되어 있지도 않은 형편이다. 따라서 본 논문에서는 교육의 자주성･전문성･정치적 중립성의 개념과 의미 및 구체적인 적용 사례를 살펴보았고 우리와 유사한 규정을 가지고 있는 일본의 교육법령에서는 이들을 어떻게 규정하고 있으며 학계의 학설과 이론 및 구체적인 판례에서는 어떻게 해석하고 있는지를 비교･검토하여 시사점을 얻고자 하였다. 그리고 나아가 우리의 교육법적 현안을 해결하기 위한 방안은 무엇인지를 검토하였다. 헌법 제31조 제4항의 교육의 자주성･전문성･정치적 중립성 및 대학의 자율성의 개념과 의의 및 구체적인 실현 방안에 대해서는 어느 정도 학계의 이론과 법원의 판례를 통하여 정립되어 있다고 할 수 있다. 그러나 헌법 제31조 제4항의 입헌목적과 헌법제정권자의 입법취지를 존중하여 해석하여 본다면 결국은 헌법 제31조 제1항의 국민의 교육을 받을 권리의 실질적 보장으로 귀결된다고 할 수 있다. 국민의 교육을 받을 권리, 좁게는 학생의 학습권을 시대적 상황에 맞게 보다 실질적이고 구체적으로 실현하기 위해서는 교육에 있어서의 자주성과 전문성 및 정치적 중립성이 요청되고, 이것이 학문의 영역과 연계되어서는 대학의 자율성(자치)로 구현된다고 보아야 한다. 정부가 교육정책을 설계하고 제도를 정착시키고자 함에 있어 이러한 헌법의 입법취지를 반영하는 것이 필요하며, 법원이 교육조항을 해석하여 적용함에 있어서도 마찬가지라고 하겠다.

Therefore, in this thesis, the concept and meaning of education's autonomy, professionalism, and political neutrality, and specific examples of application were examined, and how they are defined in Japanese education laws, which have similar regulations to ours, and how they are defined in academic theories, theories, and specific precedents. I tried to get implications by comparing and examining whether they are interpreting. And furthermore, we reviewed what is the plan to solve our educational legal issues.
It can be said that the concept and meaning of the autonomy of education, professionalism, political neutrality, and university autonomy under Article 31, Paragraph 4 of the Constitution, as well as specific implementation plans, have been established to some extent through academic theories and court precedents. However, if the constitutional purpose of Article 31, Section 4 of the Constitution is interpreted with respect and the legislative purpose of the constitutional authority is respected, it can be said that it ultimately results in the substantial guarantee of the people's right to receive education under Article 31, Section 1 of the Constitution.
In order to more practically and concretely realize the people's right to receive education, and narrowly, the student's right to learn, autonomy, professionalism, and political neutrality in education are required. It should be seen that it is implemented as (autonomy). It is necessary for the government to reflect the legislative intent of the Constitution when designing education policies and establishing a system, and the same is true for the courts to interpret and apply the provisions of education.
