사회적경제기본법(안)에 대한 고찰 — 정책 추진체계를 중심으로 — (Study on the Drafts of the Framework Act on Social Economy — Focusing on the governance system —)

초록

제19대 국회부터 현재까지 지속적으로 국회에 제출되고 있는 사회적경제기본법(안)에 대하여 입법 필요성에 대한 검토와 총칙 규정 관련 연구는 활발히 이루어졌으나 핵심 쟁점에 해당하는 정책 추진체계에 관한 심도 깊은 연구나 논의는 이루어지지 못하였다는 문제의식 하에, 본고는 현행 사회적경제 정책 추진체계를 검토하고, 사회적경제기본법(안)상 정책 추진체계가 기존의 문제점을 해결하고 입법취지에 부합하는 결과를 가져올 수 있을지에 대하여 비판적으로 검토하였다. 지금까지 제기되고 있는 사회적경제 정책 추진체계의 주요 문제점은 부처별 정책 칸막이, 중앙 및 지방정부의 연계성 부족, 행정력의 낭비, 생태계 조성의 미흡으로 요약 될 수 있으며 이는 정책 연계성과 정책 집행체계에 관한 논의로 귀결된다. 이에 관하여 본고는 주요 사회적경제기업과 관련한 현행 법제를 중심으로 현행 정책 추진체계를 정책 연계성과 정책 집행체계로 구분하여 검토하였다.
사회적경제기본법(안)상 정책 추진체계를 비판적으로 검토한 결과, 시･도 지역별 발전 기본계획 및 부문별 발전계획안과 연계하여 사회적경제 전반을 총괄하는 기본계획을 수립함으로써 종횡(縱橫)으로 정책의 연계성을 높여 입법취지에 부합하는 결과를 가져올 것으로 기대된다. 다만, 사회적경제위원회는 현행 사회적경제 전문위원회의 역할과 크게 다르지 않아 총괄기구로서 소임을 다하기 위하여 실무적인 의무를 부과하는 등 보완이 요구된다고 하겠다. 정책 집행체계에서 가장 논쟁이 되고 있는 사회적경제원의 설립에 대하여 사회적기업진흥원을 포괄 승계하되, 조례에 의해 설립 및 운영중인 광역 사회적경제지원센터와 협업을 강화하는 방안이 모색되어야 한다. 사회적경제기본법(안)은 다양한 유형의 사회적경제기업들을 위한 통합 시책과 체계적인 지원의 필요성 등에 근거하여 발의된 바, 입법 이후 정책 추진체계 구축에 대한 연구가 활발히 이루어지기를 기대한다.

영어초록

From the 19th National Assembly to the present, studies on the need for legislation and general regulations related to the Framework Act on Social Economy (draft) that have been continuously submitted to the National Assembly have been actively conducted. However, in-depth research or discussion on the governance system corresponding to the core issue has not been conducted. This paper reviews the current social economy governance system and critically examines whether the governance system in the Framework Act on Social Economy (draft) can solve existing problems and bring results consistent with the legislative purpose. The major problems of the social economy governance system that have been raised so far can be summarized as policy partitions by department, lack of connectivity between central and local governments, waste of administrative power, and insufficient ecosystem creation. This can be summarized as a discussion on policy connection and policy enforcement system. In this regard, this paper reviewed the current governance system by dividing it into policy relevance and policy enforcement system, focusing on the current legal system related to major social economy organizations.
As a result of critically examining the governance system under the Framework Act on Social Economy (draft), the basic plan for the overall social economy was established in connection with the regional development plan for each city and province and the development plan for each sector, thereby establishing policy linkages vertically and horizontally. It is expected to bring results consistent with the legislative purpose. However, the role of the Social Economy Committee is not very different from that of the current Special Committee on Social Economy, and to fulfill its role, supplementation is required, such as imposing practical obligations. The establishment of the Social Economy Center, which is the most controversial in the policy enforcement system, should be comprehensively succeeded to the Korea Social Enterprise Promotion Agency (KoSEA), but a way to utilize the expertise of the metropolitan social economy support center established and operated according to the ordinance should be sought. Since the Framework Act on Social Economy (draft) was proposed based on the need for integration policies and systematic support for various types of social economy organizations, it is expected that studies on the establishment of a governance system will be actively conducted after the legislation.
