초록

현행 헌법은 공무원에게 국민 전체에 대한 봉사자의 지위를 부여하여 국민에 대한 책임성을 강조하면서, 동시에 신분과 정치적 중립성을 보장한다. 국민 전체에 대한 봉사자로서 공무원이 가지는 헌법상 지위로부터 공익실현의무가 공무원에게 부여된다. 이러한 공익실현의무로부터 편향성 금지의 의무와 절차적 공정성의 의무가 도출될 수 있다. 공무원에게 요구되는 헌법적 의무는 법령준수의 의무, 청렴의 의무, 공정한 직무수행의 의무 등과 같은 법률적 의무로 구체화된다. 공무원의 신분과 정치적 중립성에 대한 보장은 직업공무원제도의 보장으로 이해될 수 있다. 직업공무원제도는 공무원의 신분과 정치적 중립성을 보장함으로써 공무원의 헌법적 권리를 보장하기 때문에 헌법적 권리인 공무담임권과 긴밀하게 연결된다. 다만 공무원이 국민 전체에 대한 봉사자로서 헌법으로부터 부여받은 지위에 근거하여 도출된 정치적 중립성의 의무가 직업공무원제도의 요소를 구성하는 경우에는 직업공무원제도와 공무담임권은 분리된다. 직업공무원제도가 공무담임권과 긴밀하게 연계되면 직업공무원제도를 구체화하는 입법의 합헌성을 심사하는 기준은 기본권을 구체화하는 입법의 합헌성을 심사하는 기준과 동일해야 한다. 직업공무원제도의 요소로서 포함될 수 있는 정치적 중립성의 의무를 제외하면 직업공무원제도를 구체화하는 입법의 합헌성을 심사할 때 기본권을 구체화하는 입법의 합헌성을 심사하는 기준으로 헌법적 원칙인 비례성원칙이 적용되어야 한다.

영어초록

The current constitution bestows upon public officials the position of servants to the entire nation, emphasizing their responsibility to the people while simultaneously ensuring their status and political neutrality. Derived from the constitutional position held by public officials as servants to the entire nation, they are obligated to realize the public interest. Obligations such as the prohibition of bias and procedural fairness can be derived from this duty to realize the public interest. The constitutional duties imposed on public officials include obligations such as compliance with laws, integrity, and the duty to perform their duties fairly, which are concretized as legal obligations. The assurance of status and political neutrality for public officials can be understood as guaranteed through the professional civil service system. The professional civil service system, by ensuring the status and political neutrality of public officials, is closely connected to protecting the constitutional rights of public officials, particularly the constitutional right of public neutraltiy. However, when the obligation of political neutrality, derived from the constitutional position granted to public officials as servants to the entire nation, constitutes an element of the professional civil service system, the professional civil service system and the duty of political neutrality are separated. If the professional civil service system is closely linked to the duty of political neutrality, the criteria for assessing the constitutionality of legislation that concretizes the professional civil service system should be consistent with the criteria for assessing the constitutionality of legislation that concretizes basic rights. When evaluating the constitutionality of legislation that concretizes the professional civil service system, excluding the obligation of political neutrality that can be included as an element of the professional civil service system, the constitutional principle of proportionality should be applied as the criterion for assessing the constitutionality of legislation that concretizes basic rights.
