유아교육법의 기본법으로서의 교육기본법에 관한 연구 (Study for the framework act on education as for the fundamentals on the early childhood education act)

초록

본 연구는 유아교육법, 교육기본법, 헌법의 상호관계를 알아보고 교육기본법의 구체적 내용을 유아교육의 관점에서 검토한 후 교육기본법이 유아교육법에 어떻게 전개되어 나타나는지의 대강을 살펴봄으로써 유아교육법의 연구의 기초로 하는 데 그 목적이 있다.
본 연구는 교육기본법을 유아교육법과 관련지어 연구한 문헌들이 거의 없어 헌법의 교육조항에 관한 문헌연구, 교육기본법에 관한 문헌연구, 유아교육법에 관한 문헌연구를 바탕으로 이를 유아교육법의 관점에서 교육기본법을 재구성하는 방식으로 진행한다.
본 연구의 결론은 다음과 같다.
첫째, 헌법과 교육기본법, 그리고 유아교육법은 헌법-교육기본법-유아교육법이라는 계층적 구조를 이루며, 헌법은 교육기본법과 유아교육법 등의 최고에 위치한 이들의 근거규정, 입법원리, 효력근거, 최고의 해석원리이고, 교육기본법은 헌법의 하위, 그리고 유아교육법의 상위에 위치한 유아교육법의 근거규정, 입법원리, 효력근거, 해석원리이다.
둘째, 교육의 법 영역에서 최고의 가치인 교육을 받을 권리의 보장은 유아교육과 관련하여서는 교육기본법과 유아교육법을 통하여 유아의 ‘균등’한 교육을 받을 권리의 보장으로 구현된다.
셋째, 유아교육법의 각 내용들은 헌법과 교육기본법이 구체화된 것으로 헌법, 교육기본법, 유아교육법은 서로 유기적으로 연결되어 있다.
넷째, 유아교육에 있어서 최고의 법적 가치가 유아의 ‘균등’한 교육을 받을 권리의 보장이라는 측면에서 유아교육의 전면 무상화 등의 국가적 조처가 절실하다.
다섯째, 유아교육영역에서의 많은 법적 모순은 조속히 입법적으로 해결되어야 한다.

영어초록

This study has been conducted to establish the basis for the study of the Early Childhood Education Act through three step processes; at first it will examine the relationship between the Early Childhood Education Act, the Framework Act on Education, and the Constitution of the Republic of Korea, then persue the Framework Act on Education specifically from the viewpoint of the Early Childhood Education Act, and at last analyze how the Early Childhood Education Act has been developed from the Framework Act on Education.
Due to the lack of research about the direct relationship between the Framework Act on Education and the Early Childhood Education Act, this study reconstitutes the Framework Act on Education from the perspective of the Early Childhood Education Act.
Through this research, the following five conclusions were derived.
First, the Constitution of the Republic of Korea, the Framework Act on Education, and the Early Childhood Education Act form based on their hierarchical structure. As the fundamental building block for both the Framework Act on Education and the Early Childhood Education Act, the Constitution of the Republic of Korea provides bases for their regulation, principles for their legislation and evidences for their effect. Furthermore, it serves as the top-level fundamentals for interpreting the Framework Act on Education and the Early Childhood Education Act. the Framework Act on Education, which ranks below the Constitution of the Republic of Korea but above the Early Childhood Education Act, provides bases for regulation of the Early Childhood Education Act, principles for its legislation, evidences for its effect, and fundamentals for interpreting the Early Childhood Education Act.
Second, as the most significant right among the Framework Act on Education, the pursuit of education serves as the pursuit of ‘equal’ opportunity in education for a child in the Early Childhood Education Act.
Third, since each subjects in the Early Childhood Education Act are just more specified from the Constitution of the Republic of Kore and the Framework Act on Education, the Early Childhood Education Act, the Framework Act on Education, and the Constitution of the Republic of Kore are intimately connected to one another.
Fourth, it seems necessary to provide early childhood education as free of charge in nation-wide based on the fact that the pursuit of ‘equal’ opportunity in education for a child is regarded as the most significant legal value in the Early Childhood Education Act.
Fifth, many legal contradictions in the Early Childhood Education Act should be handled through legislation soon.
