헌법상 비례성원칙 (The Constitutional Principle of Proportionality)

초록

헌법상 비례성원칙은 적합성원칙, 필요성원칙, 좁은 의미의 비례성원칙으로 구성된다. 헌법재판소의 견해와는 달리 목적의 정당성은 비례성원칙의 부분원칙에 포함될 수 없다. 아무튼 비례성원칙은 두 개의 목적과 한 개의 수단으로 이루어진 관계삼각형의 구조를 가지고, 최대화명령, 최소화명령, 최적화명령으로 재구성될 수 있다. 최대화명령을 의미하는 적합성원칙과 최소화명령을 의미하는 필요성원칙은 경험적 논증을 본질로 하는 반면에 최적화명령을 의미하는 좁은 의미의 비례성원칙은 규범적 논증을 본질로 한다. 중요한 것은 규범적 논증을 본질로 하는 좁은 의미의 비례성원칙이 비례성에 관한 논증에서 가장 핵심적인 원칙이라는 점이다. 한편 비례성원칙은 기본권의 기능에 따라 과잉금지원칙과 과소금지원칙으로 구체화된다. 하지만 평등권에 대한 제한의 경우에는 비례성원칙이 적용되지 않는다. 비례성원칙은 서로 충돌하는 법익의 우열관계를 비교할 때 적용되지만 평등권의 경우에는 대상의 같고 다름에 관한 비교가 문제되기 때문이다. 법익의 비교와 균형을 본질로 하는 비례성원칙을 적용할 때 중요한 것은 각각의 법익에 찬성하는 논거가 자유롭고 평등하게 주장될 수 있는 합리적인 절차의 보장이다.

영어초록

The constitutional principle of proportionality consists of three sub-principles: the principle of appropriateness, the principle of necessity, the principle of proportionality in a narrow sense. Unlike the opinion of the Constitutional Court of Korea, the legitimacy of end is not able to be one of sub-principles of proportionality. The principle of proportionality has a relation-triangle structure, a structure which consists of two ends and one mean, and can be reconstructed by the imperative of maximization, the imperative of minimization and the imperative of optimization. The essence of the principle of appropriateness meaned by the imperative of maximization and the principle of necessity meaned by the imperative of minimization is an empirical argumentation. In contrast, the essence of the principle of proportionality in a narrow sense meaned by the imperative of optimization is a normative (evaluative) argumentation. Important is that the principle of proportionality in a narrow sense, the essence of which is a normative argumentation, is the core of the principle of proportionality. The principle of proportionality can be concretized by the principle of over-limitation-prohibition (Übermaßverbot) and the principle of under-protection-prohibition (Untermaßverbot) according to functions of constitutional rights, according as they are rights to omission or rights to action or benefit. However, the principle of proportionality is not applied to the limitation of the right to equality. Because the principle of proportionality can be applied in the case of the comparison of colliding legal interests, but in the case of the right to equality, it is of essential concern to compare two objects regarding sameness and difference. By applying the principle of proportionality, the essence of which is the comparison and balance of colliding legal interests, it is most important to protect a certain resonable procedure in which every arguments supporting respective legal interests can be put forward freely and equally.
