난민법상 난민신청자와 인도적 체류자의 법적 지위 (Legal status of refugee applicants and humanitarian residents under the Refugee Act)

초록

우리나라는 현행 난민법이나 난민협약에 따라 제도적으로 난민을 다루고 있지만, 법규범적 및 사회적 인식의 차이에 따라 비교적 낮은 난민인정으로 인하여 난민인정을 받지 못한 난민신청자와 인도적 체류자가 제대로 된 처우를 받지 못하고 있다는 법적 지위와 인권적 쟁점이 제기되어 왔다. 현행 출입국관리법 체계에 따라 동 법령상의 체류자격과 경우에 따라서는 인도적 처우와 행정재량의 연계되어 난민신청자와 인도적 체류자는 불안전한 법적 지위로 인해 심지어 강제퇴거까지 우려해야 하는 지위에 놓여 있다. 다문화정책이든 이민정책이든 우리 사회가 풀어가야 할 또 다른 현안 역시 난민정책의 문제이다. 현행 헌법상의 인간이 갖는 가치와 국제규범인 난민협약의 내용에 따를 때 기본적으로 모든 인간은 기본적 인권을 가지고 있으며, 이를 어떠한 형태로도 침해할 수 없다. 국가는 근본적 가치질서에 따라 기본적인 사회서비스를 보장해야 하는 인권 보호의 핵심적인 수단을 실행해야 하며, 여전히 국가의 법규범적 질서 및 사회적 공감대에 의한 난민에게 인도적 서비스를 제공하는 것은 한편으로는 난민협약의 중요한 목표이다. 결국 우리나라는 난민협약의 가입국으로서 인간의 존엄을 위한 난민정책의 방향을 어떻게 설정할 것인지 지향하고자 하는 국가목표가 무엇인지에 대하여 끊임없이 연구가 되어야 할 것이다. 이민정책은 구체적으로 외국인에 대한 출입국정책, 외국인노동정책, 난민정책 등으로 언급할 수 있으며, 현행 관련 법체계에서 우리나라로 유입되는 이민자에 대한 인권과 사회통합의 목적을 갖고 있다. 본고에서 다룬 내용은 난민도 보호의 대상이고, 그 근거로 인권과 안전을 보장해야 한다는 것을 기본으로 하고 있다. 현행 난민법에 있어서 난민에 대한 정의를 비롯하여 난민인정자, 난민신청자, 인도적 체류자를 구분하고 있으며, 난민인정자에 논의는 별론으로 하고 난민신청자와 인도적 체류자의 법적 지위에서 일어나고 있는 현행 법체계에서 문제점과 개선방안을 살펴보았다. 결국 모든 인간은 인간으로서 가지는 인권을 가지고 있으며, 이는 어떠한 방식으로도 침해되어서는 아니 된다는 점에서 인간의 존엄을 위한 난민정책의 방향이 무엇인지에 대하여 우리 헌법적 가치질서에서 끊임없이 고민할 필요가 있다.

영어초록

Although Korea systematically deals with refugees under the current Refugee Act or Refugee Convention, legal status and human rights issues have been raised that refugee applicants and humanitarian residents who are not recognized as refugees are not properly treated due to relatively low refugee recognition. According to the current immigration law system, refugee applicants and humanitarian residents are in a position to worry about even forced eviction due to their unstable legal status due to humanitarian treatment and administrative discretion under the law. Another issue that our society needs to solve, whether it is a multicultural policy or an immigration policy, is also a problem of refugee policy. According to the current constitutional values of humans and the contents of the Refugee Convention, an international norm, basically all humans have basic human rights and cannot be violated in any form. The state must implement a key means of human rights protection that must guarantee basic social services in accordance with the fundamental value order, and providing humanitarian services to refugees by the state's legal order and social consensus is still an important goal of the Refugee Convention. In the end, as a member of the Refugee Convention, Korea should constantly study how to set the direction of refugee policy for human dignity. Immigration policy can be specifically referred to as immigration policy for foreigners, foreign labor policy, and refugee policy, and the purpose of human rights and social integration for immigrants flowing into Korea under the current related legal system. The content covered in this paper is based on the fact that refugees are also subject to protection, and human rights and safety should be guaranteed on that basis. The current refugee law divides refugee recognizers, refugee applicants, and humanitarian residents, and discusses refugee recognizers separately and examines problems and improvements in the current legal system in the legal status of refugee applicants and humanitarian residents. In the end, all humans have human rights as humans, and this should not be violated in any way, so it is necessary to constantly think about the direction of refugee policy for human dignity in our constitutional value order.
