대통령 개헌안과 경제민주화 (The President's Constitutional Amendment and Economic Democratization)

초록

지난 3월 26일 대통령이 발의한 개헌안은 기본권 등 여러 부분에서 긍정적인 내용을 담고 있으나 경제민주화와 관련해서는 새로운 내용이 거의 없었다. 경제민주화가 2012년 총선 국면에서부터 두 차례의 대선까지 핵심적인 사회 이슈였고, 현 정부에서도 대통령이 2017년 6.10 민주항쟁 30주년 기념사에서 ‘경제민주주의의 필요성’을 새삼 강조한 것에 비하면, 개헌안의 내용은 경제민주화적 관점에서 매우 초라한 결과물이었다.
비록 개헌이 좌절되었지만, 이번 개헌과정과 최종 개헌안의 내용에 대한 평가를 소홀해서는 안 될 것이다. 이미 끝난 일이라고 그냥 넘어간다면, 유사한 잘못이 반복될 수 있기 때문이다. 오히려 냉정한 평가를 통해 향후 개헌에 대한 발판이 마련되어야 할 것이다.
이러한 취지에서 본 논문은 87년 헌법 개정 당시의 논의부터 최근까지의 경제민주화에 대한 논의를 전반적으로 정리하고, 그 연장선상에서 최근 대통령 개헌안의 경제민주화적 측면을 비판적으로 평가한 후, 향후 개헌안에서 보완이 되어야 할 내용을 제시하고 있다.
먼저, 경제민주화를 기업의 입장에서 ‘경제민간화’로 해석하는 입장을 비판하고, 그것이 재벌민주화에만 한정되지 않음은 물론, 경제영역에까지 민주적 원칙이 적용되어야 함을 상정하고 있다. 또, 그러한 입장에서 지금까지의 경제민주화의 정책을 살펴본 후, 이번 개헌특위에 경제민주화 전문가가 없어 실제 경제민주화 관련 조문의 내용에 큰 변화가 없었다는 점을 지적하며, 다소 변화된 조항들도 큰 의미가 없음을 비판하고 있다. 마지막으로 향후 경제민주화 개헌이 현행규정과 차별성을 가지기 위해서는 현재와 같이 추상적이고 수사적인 문구보다는 하위 법률에서 구체적으로 제도화할 수 있는 정당화 근거를 헌법에 제시해야 하므로, 그러한 제도의 일환으로 스웨덴 금융통화위원회 및 협동조합, 공동결정제도 등에 대해서도 검토하고 있다.

영어초록

Even though the bill for constitutional amendment proposed by the President on last March 26th contained many positive contents such as basic human rights, there was almost nothing new related to the economic democratization. Considering the fact that the economic democratization was a key social issue from the general election in 2012 to the two presidential elections, and President newly emphasized the ‘necessity of economic democracy’ at the memorial address for the 30th Anniversary of June Democratic Uprising in 2017, the contents of the bill for constitutional amendment were such a poor result in the aspect of economic democratization.
Even though the constitutional amendment was frustrated, the evaluation of the constitutional amendment process and the contents of the final bill for constitutional amendment should not be neglected. If it is simply ignored as a past event, the similar error could be repeated in the future. Based on the objective evaluation, the foothold of the future constitutional amendment should be established.
For this purpose, this paper summarizes the overall discussions of economic democratization from the constitutional amendment in 1987 until a recent date, critically evaluates the economic democratization aspect of the recent President’s constitutional amendment in its extension, and then suggests the complements in the future bill for constitutional amendment.
First, on top of criticizing the interpretation of economic democratization as ‘economic privatization’ in the corporate position, it is not limited to the conglomerate democratization, and it is proposed that democratic principles should be applied to the economic area. Also, after examining the policies of economic democratization so far, it is pointed out that there have been no huge changes in the actual contents of the provisions related to the economic democratization as the special committee of constitutional amendment has no experts in economic democratization, so that the articles with small changes do not mean much. Lastly, in order for the future constitutional amendment of economic democratization to be differentiated from the current regulations, the grounds for justification that could concretely institutionalize sub-laws should be suggested, instead of the current abstract and rhetorical phrases. As a part of this system, the Monetary&Financial Committee of Sweden, cooperative, and codetermination system are reviewed.
