중국행정통제의 문제점과 발전방향 (Problems and Directions of Administrative Control in the Chinese Governmnet)

초록

본 논문은 제도적 차원과 운영적 차원에서 중국 행정통제의 현황과 내용을 분석하고, 주요 문제점과 변화추세를 분석하여 발전방향을 제시하는데 초점을 맞추고 있다. 제도적 차원에서 중국 행정의 외부통제에는 인민대표대회, 참정당(參政黨), 사법기관, 언론 및 NGO의 행정감독이 포함되고, 내부통제에는 행정기관의 상하급 감독, 감찰기관과 감사기관의 감독, 그리고 사스(SARS) 이후 실행된 행정문책제도가 포함된다. 문제점은 주로 통제주체의 지위와 전문성 여부, 통제법규의 미흡, 정보공개제도와 정부업무평가제도의 미숙성 등이다. 하지만 지난 기간 집권당의 강력한 의지, 경제발전과 사회구조에 따른 국민욕구의 분출, 통제주체에 대한 개혁 등으로 인하여 중국의 행정통제는 가시적인 변화를 가져오고 있다. 물론 정치체제의 문제로 인한 태생적인 한계 역시 뚜렷하다. 즉 현재의 행정통제의 변화와 발전은 정치와 행정 권력에 대한 자발적인 행위라기보다는 집권당과 지도자가 “베풀어주는”식으로 추진되는 것이라는 한계가 있다. 따라서 중국 행정통제의 향후 발전은 중국 정치체제 개혁의 진행 상황에 따라 크게 좌우될 수 밖 에 없을 것이다.

영어초록

This paper focuses on understanding the status quo and the contents of
administrative control in China from both institutional and operational perspectives, and comes up with suggestions on the direction of its future development by analyzing its existing problems and tendency for change. At the institutional level, external administrative control in China is carried out by the People’s Congress, participating political parties, judicial organs, media and NGOs, while internal administrative control in China is conducted by superior administrative organizations, supervision institutions, auditing organs, and the administrative accountability system adopted since the outbreak of SARS. Existing problems currently lie in the status and professionalism of supervision bodies, the relevant laws, the Information Disclosure System, and the Government Performance Evaluation System, etc. It is undeniable that due to the firm will of the ruling party, the continuous reform on supervision bodies, the demands of the public resulting from economic development and the transformation of the social structure, obvious changes have taken place in the administrative control of China. At the same time, the inborn limitations caused by the political system increasingly stand out (i.e. the change and development in China’s administrative control is a result of the benefactions from the ruling party and leaders rather than their spontaneous choices. Therefore, the future development of administrative supervision in China will only rely on the process of political reform.
