기술규제, 사례와 정책적 시사점 (Technological Regulations : Cases and Policy Implications)

초록

지금까지 규제는 주로 행정규제 차원에서 경제적 규제와사회적 규제로 나눠 접근해왔다. 하지만 과학기술의 빠른발전과 확산이 경제사회에 지속적으로 큰 영향과 파급효과를 미침에 따라 또 다른 관점에서의 규제에 대한 접근이 요구된다. 기술규제는 이러한 맥락에서 ‘혁신주체의 혁신활동에 의무를 부과하거나 요건을 부여하는 정부의 기술 관련제도’라고 정의할 수 있으며, 기술 공급자와 수요자 간 정보비대칭성으로 발생하는 문제를 해결하기 위한 제도적 장치이다. 기술규제는 전통적으로 기업에 부담을 주어 혁신을저해하는 것으로 이해되어 왔으나, 최근 안전, 환경보호, 신산업창출 등과 같은 긍정적 효과도 있는 점이 밝혀지고 있다. 정책적 아젠다로 기술규제가 주목받고 있는 이유는 실제 기업의 혁신활동에 직접적 영향을 주고 시장진입에 결정적 요인으로 작용하여 새로운 산업창출과 국가간 교역에 실질적인 영향을 미치기 때문이다. 또한 그동안 일반 행정규제에 비해 규제내용에 대한 이해가 어렵고 파급효과도 예측하기 어려워 정책적 사각지대에 놓여 있었던 점도 원인 중하나이다.
본 연구에서는 먼저 기술규제의 개념과 특징을 이해한 후한국의 기술규제 현황과 문제점을 살펴본다. 이후 최근 기술발전과 산업환경 변화에 의한 산업별 구체적인 기술규제사례를 제시한다. 법령 조항 분석 결과, 기술규제 유형 중제조⋅품목 허가, 창업, 인증 등의 비중이 상대적으로 큰 점은 시장 진입장벽이 높은 것을 시사하고 있다. 자동차, 에너지, 의료, 화학 등 주요 산업별 사례에서는 기존 산업별 경직된 규제시스템이 빠른 기술발전과 융합의 진전을 수용하기 어려운 현실을 설명하고 있다. 다음으로 기술규제 개선정책수요가 발생하는 원인을 다양한 차원에서 해석한다. 정보비대칭성과 규제지체의 발달, 취약한 인식과 대응, 기술규제 영향력의 국제적 확산, 민간자율 규제시스템의 취약성등이 이에 해당한다. 결론에서는 이러한 기술규제 문제를해결하기 위한 혁신친화적 규제시스템 구축, 규제공백 해소, 글로벌 기술규제와의 조화, 민간참여 확대 및 미래지향적지원인프라 구축 등을 제시하고 있다.

영어초록

Regulations have been mostly approached by categorizing them into economic and social regulations from the administrative regulation perspective. However, it is now time to approach regulations from a different perspective in tandem with the continued considerable influence and ripple effects that the rapid development and spread of science and technology have on the economy and society. Technological regulations can be defined as ‘the government’s technology-related system that imposes obligations or sets requirements on innovative activities that are conducted by companies or innovators.’ It is an institutional mechanism that is used to resolve issues that arise from information asymmetry between technology providers and users. Technological regulations have traditionally been regarded as a factor that hinders innovation by placing a burden on companies.
However, their positive effects have recently been revealed, including safety, environmental protection, and new industry creation. Technological regulations garner attention as policy agenda because they have a direct impact on companies’ innovative activities and serve as a decisive factor in market entry, and thus have practical effects on new industry creation and cross-border trade.
Another reason is because they were previously a policy blind spot, an outcome of difficulties in understanding regulation content compared to general administrative regulations and in forecasting ripple effects.
This study examines the status and issues of Korea’s technological regulations, and then presents detailed technological regulation examples for different industries. Results of an analysis of statutory provisions indicate that manufacturing and item permission, business startups, and certifications account for a relatively high proportion from among technological regulation types. This implies that market entry barriers are high. Cases of major industries, including the automobile, energy, medical treatment, and chemical industries, reflect that it is difficult for the rigid regulatory systems in different industries to accommodate rapid technological development as well as advancements in convergence. The study then interprets the causes of demand for technological regulation improvement policies from various perspectives. These include greater information asymmetry and regulatory lag, weak understanding and response, global spread of the influence of technological regulations, and vulnerability of private autonomic regulatory systems. In its conclusion, the study sets forth a policy direction to resolve these technological regulation issues that includes establishing innovation-friendly regulatory systems, striking harmony with global technological regulations, increasing private sector participation and building a futuristic support infrastructure.
