상속에 관한 등기의 제문제 (A Study on Registration of Inheritance)

초록

상속등기에 있어서 여러 가지 문제가 발생하는데 그중에서도 특히 상속분이 양도된 경우에 그 상속등기는 어떻게 하여야하는지가 문제가 된다. 즉 상속분이 양도된 경우에는 상속인 지위의 양도이므로 양수인은 상속인과 같은 지위에 있게 되고, 상속분을 양도받은 때부터 양수인은 상속재산분할에 참가할 수 있으며, 상속재산분할의 협의가 있었던 경우에는 분할의 효과가 소급하므로 상속재산분할이 된 후에 ‘상속’을 원인으로 하여 직접 상속등기를 할 수 있다. 또 제3자에게 상속분을 양도한 경우, 상속분의 증여 또는 상속분의 매매를 등기원인으로 하여 제3자에게 이전등기를 하거나 상속재산분할을 원인으로 하여 직접 양수인 단독명의로 이전등기를 할 수 있다. 이와 관련하여 그러한 상속등기는 어떻게 하여야 하는지의 문제가 있다. 또 상속재산의 경매(민법 제1037조)의 경우, 공동상속인 중 1인이 가액변제를 하고 강제집행을 정지시킨 경우에는 공동상속등기를 한 후에 ‘가액변제’를 등기원인으로 하여 변제를 한 상속인은 다른 공동상속인에게 상속지분이전등기를 청구할 수 있다. 이 경우에 당해 상속재산은 변제를 한 상속인의 소유로 되는지와 그의 소유로 된다고 하면 그 등기절차는 어떻게 하는지, 그리고 가정법원이 상속재산에 대하여 경매분할을 명한 경우에 상속재산을 매수한 자는 피상속인 명의로부터 직접 이전등기를 받을 수 있는지 여부의 문제, 또한 상속재산이 공유지분인 경우에 그것은 제267조에 의하여 다른 공유자에게 지분비율로 귀속되는지 아니면 제1057조의 2에 따라 특별연고자에게 분여될 수 있는지 여부가 문제가 된다. 그밖에 상속재산 외의 재산을 양도하는 방법인 대상분할을 할 수 있는지 여부, 할 수 있다면 그 등기원인은 무엇인가에 대하여 문제가 되고 있다. 본 논문은 이러한 점을 중점으로 상속등기의 여러 가지 문제점과 그 해결방안에 대하여 고찰하였다.

영어초록

When it comes to registration of inheritance, as transfer of inheritance means the transfer of the position as heir, the assignee is in the same position of the heir, and the assignee can participate in inheritance division from the time of transferring the inheritance. When there is consultation on division of inheritance, the effect of division is retroactive, and thus 'inheritance' can be directly registered after the division of inheritance. Besides, when the inheritance is transferred to a third party, donation or transaction of the inheritance can be registered to a third party as the cause of registration, or the transfer can be directly registered with the single name of the assignee as the cause of division of inheritance. In this regard, as to how to deal with the registration of such inheritance and as to auction of inheritance(Civil Law Art. 1037), when one of co-heirs repays the values and stops compulsory execution, the heir that has repaid after joint inheritance registration with 'payment of values' as the cause of registration cannot apply for registration of transferring the inheritance to another co-heir. In that case, the following issues are raised: does the concerned inheritance come to belong to the heir who has repaid; if so, what is the procedure of registration; when the family court orders auction division concerning the inheritance, can the purchaser of the inheritance directly accept the registration of transfer in the name of the heir; when the inheritance is a joint-ownership portion, can it belong to another heir's share according to Art. 267, or can it be divided to the special related person according to Art. 1057-2; besides, is object division, the way of transferring properties other than inheritance, possible. If possible, what is the cause of the registration. This study focuses on these matters and investigates on various issues concerning registration of inheritance.
