통상의 기술자에 관한 연구 (Study on the ‘ordinary skilled person’)

초록

특허법에 있어 ‘발명이 속하는 기술분야에서 통상의 지식을 가진 자’를 평균적인 기술자로서 출원시에 당해 기술분야의 기술상식을 보유하고 있으며 연구를 위하여 통상의 수단 및 능력을 자유롭게 이용할 수 있고, 출원시 기술수준에 있는 것을 입수하며 자신의 지식으로 할 수 있고, 발명과 관련되는 기술분야의 지식을 자신의 지식으로 할 수 있다고 가정된 자를 일컫는다.
우리나라 특허법 제29조와 제42조에서는 통상의 지식을 가진 자를 규정하고 있으며 이는 표면적으로는 명세서 기재요건에서의 지식의 범위와 진보성 판단에 있어서 지식의 범위가 동일한 것으로 기재되어 있다. 특허를 출원 할 당시의 선행발명으로부터 그 발명을 용이하게 발명할 수 있는지를 보아야 할 것이고, 진보성이 부정되는지 여부의 판단대상이 된 발명의 명세서에 개시되어 있는 기술을 알고 있음을 전제로 하여 사후적으로 통상의 기술자가 그 발명을 용이하게 발명할 수 있는지를 판단하여서는 아니 된다. 명세서 기재요건의 그 발명이 속하는 기술 분야에서 통상의 지식을 가진 자의 지식의 범위는 기술 분야 전반에 걸쳐 지식을 가진 자가 아닌 당해 분야에서 평균적으로 지식을 가진 자로 해석이 되어 지며, 진보성 판단의 기준이 되는 그 발명이 속하는 기술 분야에서 통상의 지식을 가진 자의 지식의 범위는 그 발명이 속한 기술 분야에 대한 통상의 지식을 가지고 있는 자로 해석이 가능하므로 명세서 기재요건의 통상의 지식의 범위보다 진보성 판단에서의 통상의 지식의 범위가 더 넓을 수 있다 하겠다. 따라서 명세서 기재요건 판단 시나 진보성 판단 시에 기술 분야와 기술수준을 분명히 확정하는 것이 반드시 필요하고 우선시 되어야 하겠고, 통상의 지식을 가진 자의 기술 분야와 기술 수준을 확정할 때에는 명세서 기재 정도를 만족하는 지 여부와 용이하게 창작 가능한 지의 판단이 필요할 것이다.

영어초록

Inventions has to be in a complete form in order to file as a patent. In here, the complete invention means an invention that consists of a specific and objective details which can be replicated by a person of ordinary knowledge in the area of patent application. The judgement for the patent is done based on the overall purpose, configuration and operational effect of the invention etc. as described in the specification considering the level of technology at the time of filing.
In patent law,‘the average engineer with ordinary knowledge in the technical area of pending technology’is the person who retains the common sense of the technology, can use usual means and abilities freely for the research, can utilize the filed inventions as his own, and can make his own knowledge for the technical details of the related area at the time of filing in the field of technology and research.
At the time of filing the patent, the invention should be evaluated whether it can be easily facilitated from the prior invention. The progressiveness of the invention is negative or not is determined whether the invention is disclosed in the specification of technology with the assumption that the patent application at the time should usually post technicians to facilitate the invention.
Person having ordinary skill in the art of the invention is interpreted as the non-self-knowledge across the technology sector for the range of knowledge concerned with average knowledge in the field of listed specification requirements. Knowledge of the scope of the person having ordinary skill in the technical field of the invention pertains to the inventiveness of judgment can be interpreted as normal for the invention belongs to the technical field of knowledge, so the knowledge of the normal requirements specifications listed will be wider than the range of progressiveness in the judgment of ordinary skill of the range. Therefore, at the time of judging the inventive step or the requirements of the listed specifications, it is important to confirm the technical area and level. Also, at the time of confirming the technical area and the technical level of the person with ordinar skill, it is important to check if the invention satisfy the technical description and can be easily implemented or not.
