행정상 강제수단의 관계와 체계화 방안 (A Study on the Relation and Systematization of the Administrative Compulsions)

초록

이 글은 사익과 공익의 조화를 위하여 특정 상황에 어떠한 행정상 강제수단이 가장 적합하고 행정법상 일반원칙을 준수한 것인지에 관하여 살펴보는 데 목적이 있다. 이러한 논의는 여러 행정상 강제수단들 간의 관계를 체계적으로 이해함으로써 행정의 적법성과 수용가능성을 제고하는 데에 기여할 수 있을 것이다.
현행 행정상 강제수단의 관계 및 체계화에 관하여 검토해 보면 다음과 같다. 먼저 행정기관의 의무부과행위가 선행되는 경우이다. 철거 등이 문제되는 경우에는 대집행을 우선적으로 적용하고 이행강제금을 보충적으로 적용한다(대체적 작위의무). 폐기ㆍ폐쇄ㆍ퇴거 등이 필요한 경우 대집행을 먼저 고려한 뒤 직접강제를 적용한다(대체적 작위의무). 금전부과로 자발적 이행이 예상된다면 이행강제금이, 직접적인 실력 행사가 필요하다면 직접강제가 적용된다(비대체적 작위의무, 부작위의무, 수인의무). 필요 시 강제징수도 활용될 수 있다(금전납부의무). 다음으로 행정기관의 의무부과행위를 기다릴 여유가 없는 급박한 상황에서 현저한 공익 침해를 방지하기 위하여 불가피한 경우에는 최후수단으로 즉시강제를 적용한다. 아울러 새로운 의무이행확보수단도 행정목적에 따라 선택적으로 활용할 수 있다(작위의무, 부작위의무).
행정상 강제수단의 체계화 방안으로서 일반법 제정 여부가 논의되고 있으나, 법률유보 원칙을 준수하고 각각의 행정목적을 구체적으로 실현하는 데 보다 실효성이 있는 현행 개별법 규율체계를 유지하는 것이 바람직하다. 나아가 강제수단 간의 체계적 이해를 전제로 개별법령의 미비점을 보완하는 입법 개선작업을 지속하는 것도 필요하다.

영어초록

This article aims to review what Administrative Compulsion is appropriate for a specific situation and whether it is satisfied the general Principles of the Administrative Law for pursuing the harmonization of private rights and pubic interests. Such an examination can be contributed to enhance legitimacy and acceptability of the administration by understanding the relation of several Administrative Compulsions systematically.
The relations and systematic understandings concerning current Administrative Compulsions are as follows. First of all, there are some cases that an administrative agency’s imposition of duties is preceded. In case of a demolition, the Execution should be applied preferentially, and the Enforcement Fine should be considered complementally(Alternative duty to act). In case of a discard, closure and ejection, the Execution should be considered first, and after that the Direct Compulsion should be selected(Alternative duty to act). When a voluntary performance of duties is anticipated the Enforcement Fine can be applicable, but in case that a direct use of force is needed the Direct Compulsion should be applied(Irreplaceable duty to act, Omission duty, Duty to endure). If necessary, the Compulsory Collection can also be considered (Duty to pay). In the second place, In case of urgent circumstances that can not afford to wait an administrative agency’s imposition of duties along with inevitable situations to protect noticeable pubic interests, the Immediate Compulsion should be applied as a last measure. Also newly emerged Methods to secure performance of duties will be used selectively in accordance with those administrative purposes (Duty to act, Omission duty).
Some has said that the General Legislation is required for the systematization of the Administrative Compulsions. However it is reasonable to maintain current Individual Legislation regulation system, because current system can ensure observing the Doctrine of Statutory Reservation and seems to be more effective measure to accomplish individual administrative purposes specifically. Furthermore, it is also necessary to continue the improvement works to supplement some deficiencies of current individual legislations on the ground of systematic understandings concerning the Administrative Compulsions.
