초록

이 연구는 간호법 제정 과정과 거부 사례를 법정치학적 관점에서 분석함으로써 전문직 규제정책의 입법 과정에 내재된 정치적 동학과 헌법 구조의 상호작용을 고찰하는 것을 목적으로 한다. 간호법 제정을 둘러싼 갈등은 단순한 직역 간 이해관계 대립이 아닌, 정책 결정 과정에서의 이익집단정치와 헌법상 권력분립 구조가 복합적으로 작용한 결과로 이해될 수 있다. 이에 본 연구는 간호법 제정 시도의 역사적 맥락과 찬반 논리를 체계적으로 검토하고, 이익집단정치이론, 정책옹호연합모형, 대통령제 헌법 구조 및 정당정치의 관점에서 간호법 제정과 거부의 정치적 역학을 분석한다. 간호법 제정 과정의 주요 국면을 살펴보면, 제21대 국회에서는 야당 주도로 간호법이 통과되었으나 대통령의 법률안거부권 행사로 무산되었고, 제22대 국회에서는 의정갈등이라는 외부적 충격에 따른 정책옹호연합의 재편으로 여야 합의하에 간호법이 최종 제정되었다. 특히 현대 정당정치의 현실 속에서 대통령의 법률안거부권 행사가 갖는 헌법적 의미와 한계를 비판적으로 성찰하며, 한국 보건의료정책이 보여주는 구조적 취약성과 단기적 정치적 고려에 의한 즉흥적 정책 결정 과정을 실증적으로 분석하고자 하였다. 결론으로 지속가능한 보건의료정책 수립을 위해서는 절차적·구조적 측면에서의 제도 개선과 합의정치의 정착이 필수적임을 제시한다. 또한 간호법 제정 사례를 통해 보건의료법정책 형성 과정에 대한 법정치학적 이해를 제고하고, 전문직 규율의 제도화에 있어 정치적 역학관계를 고려한 정책적 접근의 중요성을 강조한다.

영어초록

This study examines the legislative process and veto case of the Nursing Act from a legal-political perspective, exploring the interaction between political dynamics and constitutional structures inherent in the legislative process of professional regulatory policy. The conflict surrounding the Nursing Act legislation can be understood not simply as a clash of interests between professional domains, but as a complex interplay of interest group politics and constitutional separation of powers in the policy-making process.
This research systematically reviews the historical context and arguments for and against the Nursing Act legislation, analyzing the political dynamics of its enactment and veto from the perspectives of interest group politics theory, advocacy coalition framework, presidential constitutional structure, and party politics. Examining the key phases of the Nursing Act legislation process reveals that in the 21st National Assembly, the opposition-led Nursing Act passed but was ultimately nullified by the presidential veto, while in the 22nd National Assembly, the Act was finally enacted through bipartisan agreement following a reconfiguration of policy advocacy coalitions triggered by the external shock of medical-government conflicts.
The study critically reflects on the constitutional significance and limitations of the presidential veto power in the context of contemporary party politics, and empirically analyzes the structural vulnerabilities and improvisational policy-making processes of Korean healthcare policy driven by short-term political considerations. The research concludes that procedural and structural institutional improvements, along with the establishment of consensus politics, are essential for developing sustainable healthcare policies.
Through the case of the Nursing Act legislation, this study enhances legal-political understanding of healthcare policy formation processes and highlights the importance of policy approaches that consider political dynamics in institutionalizing professional regulation, thereby providing implications for the development of similar professional regulatory policies in the future.
