헌법과 민주시민교육의 방향 (The Constitution and the Orientation for Democratic Citizenship Education)

초록

우리 교육기본법은 교육의 목표를 민주시민 육성에 두고 있다. 민주시민교육의 지향점은 헌법에서 찾는 것이 그 어떤 기준보다도 가장 안전하고 타당하다고 생각된다. 왜냐하면 헌법은 국가의 최고 법규범이자, 민주주의 법이기 때문이다. 하지만 헌법조문을 가르치는 것이 민주시민교육이 될 수는 없다. 민주시민교육은 우리 국민이 주권자로서 어떤 목적으로 헌법을 제정하였으며, 그것이 훼손되었던 역사와, 그로부터 다시 헌법을 복원시켰던 저항권과 헌법수호의 과정과 의의, 그리고 앞으로 헌법을 어떻게 운영하고 실현해야 하는가 하는 것을 주권자적 관점에서 이해하고 참여케 하는 교육이 되어야만 한다. 그래서 민주시민교육은 헌법조문이 아닌 헌법조문의 배경에 있는 헌법적 가치와 정신에 대한 이해와 훈련을 통한 생활 속의 체질화가 그 목표이자 내용이 될 것이라고 본다.
교육은 상황을 떠나서는 이루어질 수 없다. 그래서 우리는 현재의 헌법상황을 알아야 하고 헌법이 지금 우리에게 무엇을 할 것을 요구하고 있는가를 헌법에서 찾아야 한다. 헌법은 국가비전을 제시한다. 지금은 우리나라가 복지국가사회의 법단계를 실현함으로써 헌법의 꽃을 만개시켜야 할 때다. 동시에 인류공영과 세계평화에 기여함으로써 헌법전문의 내용을 완성시켜야 하는 지점에 이르렀다. 그러나 현실사회는 이에 부응하지 못하기 때문에 심한 모순을 느끼고 있다. 헌법의 과제와 헌법현실이 충돌하고 있다. 국민들은 대의제민주주의 전체에 대한 불신으로 가득 차 있다.
복지국가와 통일, 세계평화에 대한 기여라는 시대적 과제를 해결하기 위해서는 주권의 확립이 요구된다. 따라서 국민들은 복지사회에 맞는 시민이 되어야 하고, 동시에 이러한 역사적, 헌법적 사명을 완수하기 위한 이른바 ‘주권자적 인간’이 되어야 한다. 이것이 민주시민교육의 목표가 되어야 한다. 주권자적 인간을 육성하기 위해 교육의 내용과 절차 그리고 교육환경 모두가 철저히 실질적 민주주의로 변화되어야 한다. 심의민주주의는 그 대안이 될 것이다.

영어초록

Basic Education Act puts its object on the education for democratic citizenship. The orientation for democratic citizenship education seems to be secured through the Constitution the most clearly and distinctly among all kinds of standards as the Constitution is the supreme law and in itself the law of democracy as well. However every single article of the Constitution cannot be the object of the education. Rather than that, the background of the Constitution making ages or thereafter the history of the dictatorship and the coup d’etat by the military regime, and the story of the attainment of the restoration of the democratic government and citizens’ continuous resistant movement as legitimate sovereign should be the major topic of the education. Of course, the Constitutional mission for the people should be taught alongside how to realize as well as keep up our Constitution in the best condition. Participation education must be weighted for the purpose of building democratic citizens. Therefore, in the democratic citizenship education we put an emphasis on the lesson of the principles, the values, the spirit of the Constitution rather than the exact meaning of the written articles.
Education is never context-free. We have to start, therefore, to find where we are, and where to go from the point of the Constitutional view, the book of national vision. Now is the time when we must go toward the welfare society and make our Constitution in full bloom by realizing the responsive law, the last stage of development of law. Simultaneously, we must advance to contribute to the prosperity of humankind as well as peace of the world that the preamble of the Constitution vividly provides. Severe contradiction between the Sein and the Sollen of the Constitution can be felt nowadays. Constitutional diastrophism is immanent. National distrust about the representation system seems very deep.
Steadfast sovereign is categorical to respond to the historical challenges such as realizing of welfare state, reunification, world peace. We all at this moment should be converted to ‘sovereign person’ who is a master capable of all kinds of Constitutional mission. This can be the object of democratic citizenship education. Whatever that has been, but is no more valid should be cast off as ‘Old’, ‘New’ things and thoughts should replace them. Substantive democracy must be introduced to foster and cultivate sovereign person during the education. Deliberative democracy can be an alternative for a way of democratic education.
