물관리기본법의 평가와 그 과제 (The Appraisal and the Tasks of the Framework Act on Water Management)

초록

물관리일원화 일환으로 2018. 6. 12. 제정된 「물관리기본법」은 국가·유역물관리위원회(이하 ‘물관리위원회’라 한다)의 운영, 국가물관리기본계획(이하 ‘국가계획’이라 한다)과 유역물관리종합계획(이하 ‘유역계획’이라 한다)의 수립, 물분쟁의 조정 등의 근거 규정을 마련함으로써 통합물관리라는 새로운 이정표를 제시하고 있다. 그러나 완전한 통합물관리의 길은 아직 멀다고 할 수 있다. 기본법이 갖는 일반적인 한계라고 할 수 있지만 애매모호한 규정, 실효성이 떨어지는 규정 등이 다수 발견되고 있으며, 관련 법과의 체계성·연계성이 떨어져 최상위의 기본법으로서의 위상에도 부족한 측면이 있다. 물관리위원회의 역할과 기능상의 한계, 국가계획·유역계획과 다른 물관련 계획과의 중복성, 물분쟁 조정 대상의 불명확화와 그 효력의 약화, 다른 법제도·정책과의 연계규정의 미비 등이 대표적인 예이다. 이에 비록 최근에 제정되었지만 동법에 대한 개정이 검토되어야 한다. 이는 물 문제가 당장의 문제만이 아니라 백년, 수백년 지속될 문제가 분명하기 때문이다.
동법이 통합물관리라는 오랜 숙원 사업을 급한대로 끈 상황에서 동법이 제정되고 얼마 되지 않아 개정한다는 것이 당장의 현안이 아니고 현실성·타당성이 떨어지는 것이라고 할 수 있다. 그렇다고 하더라도 최소한 개정 필요성이 있는 부분에 대한 중간 점검은 의미가 있다고 할 것이다. 통합물관리가 연착륙을 하고 정상궤도에 오르기 위해서는 조만간 어떤식으로든 다시 손질을 해야 하기 때문이다. 개정 방향은 분명하다. 물관리위원회의 기능 및 역할 강화(행정기관으로서의 지위 명시, 권한의 확대, 독자적 예산 확보), 국가계획과 유역계획의 체계성·효율성 제고(국가계획 수립권자를 국가위원회로 변경, 중복성이 있는 계획의 통폐합), 물분쟁 조정 대상의 명확화와 실효성 확보(법적 구속력 부여), 법체계성·종합성·연계성의 제고(관련 법·규정과 연계 규정) 등이다.

영어초록

The Framework Act on Water Management, which was enacted on June 12, 2018 as part of an initiative to unify water management, has provided a new milestone through providing ground rules needed to operate the National/Watershed Commission on Water Management, establish plans such as the Framework Plan for National Water Management (FPNWM) and the Comprehensive Plan for Watershed Management (CPWM), and to adjust disputes related to water. Still, there is a long way left to go in order to reach true integration in managing water resources. A number of ambiguous and ineffective regulations - though they may be considered typical flaws of all basic laws continue to be found in the Framework Act. The Act also lacks consistency with other related laws, making it somewhat insufficient to be cited a top framework act. For example, the role and function of the National/Watershed Commission on Water Management remain limited, and plans such as the FPNWM·CPWM and other water related plans tend to overlap one another. The vagueness in defining what is and is not subject to water disputes and weak force of the decision, and the lack of linkage to other law and policy are also examples of what needs to be improved. Thus, there is a need to consider revision of the current Act, despite the fact that it was enacted quite recently. Such need is imperative not just because the water management issue is an imminent problem, but also because it would affect decades and generations to come.
While it may sound unrealistic and unreasonable to amend the Act that has just been enacted, an interim review of at least some parts of the Act that needs revision would still be deemed meaningful. That is because the Act would need to be amended in any way in order for it to soft-land and function well. The direction is clear, and that includes the strengthening of the Commission’s role and function(clarifying legal status as national agency, enlarging authority, ensuring independent budget), enhancing efficiency in laying out the FPNWM and the CPWM(change of establisher of FPNWM, integration of duplicated plans), clarifying the subject of water dispute adjustments and ensuring effectiveness of the decision(providing legal force to adjustment), and improving legal systematization and the coherence among related laws and systems(provision of linkage with related laws and regulations).
