「아동학대범죄의 처벌 등에 관한 특례법」 개정의 필요성 (A Study on the Need to Revise 「ACT ON SPECIAL CASES CONCERNING THE PUNISHMENT, ETC. OF CHILD ABUSE CRIMES」)

초록

아동학대는 동서고금을 막론하고 아동에 대한 훈육이라는 명분으로 가정, 사회 모든 영역에서 부모 등 보호자에 의해 발생하고 있다. 스스로의 방어권이 미흡한 아동은 부모 또는 성인에게 의지할 수밖에 없고 그러한 상황에서 발생되는 학대는 “사랑의 매”로 때론 “엄한 교육”으로 용인되어 왔다. 그렇기 때문에 피학대자나 학대자는 학대와 훈육에 대한 판단이 쉽지 않고, 소위 중한 학대가 발생하더라도 피해아동은 자신의 방어나 외부적 도움 요청을 하기에는 현실적으로 어렵다. 이러한 아동학대는 극단적으로 죽음 또는 신체적․정신적으로 영구적인 상처를 남기기 때문에 엄한 처벌을 통한 재발방지 및 예방이 절실하다. 하지만 현재 우리나라 학대 피해아동 보호 체계는 사례발굴을 통한 적극적인 사전예방 중심이 아니라 학대발생 후 신고를 통한 사후대처 위주여서 아동학대 예방 및 재발방지에 대한 보다 적극적이고 실질적인 정책이 요구된다. 이러한 조치 중 하나로,「아동학대범죄의 처벌 등에 관한 특례법」이 제정되고 이후 아동학대에 대한 사회적 인식이 증가하고 있다. 그러나 국가는 사생활영역인 가족/가정에 대한 개입의 최소화, 특히 친권자를 자녀의 양육, 보호, 부양의 1순위로 두고 친권행사에 대한 개입에 상당히 소극적이다. 동법 역시 입법목적을 아동학대범죄의 처벌 및 그 절차에 관한 특례와 피해아동에 대한 보호절차 및 아동학대행위자에 대한 보호처분을 규정함으로써 아동을 보호하는 것에 두고 있다. 그러다보니 실질적인 피해아동보호와 아동학대 재범방지 및 예방에 한계점을 나타나고 있다. 이에 국회에서 동법에 대한 개정 발의안을 제안하고 있으나, 대부분 중한 아동학대범죄에 대한 법정형을 높이자는 내용이며 그나마 발의안 대부분은 계류 중에 있다. 이에 본 연구에서는 동법규정의 한계성과 국회 개정발의안의 내용을 검토하여 아동학대예방과 피해아동보호를 위한 실효성이 있는 개정안을 제시하고자 한다.

영어초록

Child abuse is a cause of discipline for children regardless of whether they are in the east or west, and is caused by parents or guardians in all areas of society. Children who have insufficient self-defense have no choice but to depend on their parents or adults, and the abuse that occurs in such situations has been accepted as ‘the rod of love’ and sometimes ‘strict education’. Therefore, it is not easy for the abusers or the abused to judge if it is ‘abuse’ or ‘discipline’, and even if there is so-called serious abuse, it is difficult for children to defend themselves or to request outside help. Such child abuse can cause death of the ill-treated in the extreme or permanent physical, mental impairment, so it is urgent to make arrangement for recurrence prevention through severe punishment. However, the protection system for the abused children in Korea is not focused on active precautionary program, through case findings, but rather devoted to posterior measures after abuse report, more active and practical policies are needed to prevent child abuse in order to prevent child ill-treatment and relapse prevention. As one of these measures, the "Special Act on the Punishment of Crime of Child Abuse" was enacted, since then social awareness of child abuse has been increasing. However, the state is quite passive in minimizing the intervention of the family which is perceived as privacy domain, especially when interfering with the exercise of parental rights. because parental guardians are the considered as the first priority for raising, protecting, and supporting children. The law also aims to protect the child by stipulating the legislative purpose of punishment for child abuse crimes and exception about its procedure, protection procedures for victims and protective disposition regulations against child abusers. Therefore, there are limitations in the prevention of actual child victims and child abuse prevention and repeated crime. Accordingly, the National Assembly proposes amendments to the Act, most of them are aimed at raising the legal term of imprisonment of serious child abuse crimes, and most of the proposals are still pending. In this study, I would like to review the limitations of the Act and the contents of the National Assembly revision initiative with a hope to propose an effective revision for the prevention of child abuse and effective protection plan for the victims.
