In Korea, there is an employment law which is divided into 110 specific laws. I will introduce two main laws: the ‘Basic Employment Policy Act’and ‘Labor Standards Act’ supported by the‘Act on Equal Employment and Support for Work-Family Reconciliation’,the ‘Act On Foreign Workers Employment, ETC’ and the ‘Act On Employment Promotion And vocational Rehabilitation For Disabled Persons’.
First of all, in the case of ‘Basic Employment Policy’, there are 44 articles. This goal of this law is to improve the working abilities of nationals, give them more chance for getting jobs, and balance the supply and demand of employees. By enacting this law, employees or potential employees can have freedom in selecting jobs, and rights of working. Also, the hiring policy will stimulate applicants’ voluntary effort to find jobs.According to this law, the employers can’t discriminateagainst applicants by their sex, religion, age, physical condition, social status, origin, educational background, marriage or pregnancy, and clinical history. They should guarantee the equal chance of employment for each applicant.

However, this law also clarifies the limitations and responsibilities of foreign employees. The employers can hire Korean workers first and if there are not enough workers for particular jobs, then they can hire foreign employees. For foreign employees, their employment is limited to 3 years from their entrance. Also, foreign employees should get particular education to get jobs at the organization the country selects and take the ‘Korean ability exam’. They should also buy insurance to return to their home countries.
