자율주행자동차 수용성 조사에 기초한 법제 개선방향 (A Study on the Improvement of Legal System Based on the Survey of Acceptance of Self-Driving-Car)

초록

자율주행자동차가 도로 위를 달리는 상상은 곧 현실이 된다. 우리나라를 비롯하여 대다수의 국가가 2020년에 제한적(NHTSA Level 3) 또는 조건부 자율주행자동차(SAE Level 3)의 상용화를 목적으로 교통인프라와 법적인프라 구축을 마무리하고 있다. 약 100년 동안 사용해오던 기존의 자동차와는 전혀 다른 개념의 자율주행자동차는 국내외 법률체계의 시급한 정비를 요구하고 있어, 법학자와 입법자의 발걸음도 빨라지고 있다.
저자는 보험법학자로서 자율주행자동차를 현재의 자동차보험제도로 적절하게 규율할 수 있는가에 대한 의문을 가지고 있었으며, 선행연구에서 자율주행자동차 전용보험상품의 개발이 필요함을 주장한 바 있다.
새로운 기술에 적용할 법률과 제도의 마련은 동 시대를 살고 있는 구성원의 법의식과 동떨어질 수 없으며, 따라서 자율주행자동차에 대한 국민의 수용성에 대한 조사연구가 필요하다고 생각한다. 저자는 부산시민을 대상으로 자율주행자동차에 대한 인지여부, 자율주행자동차의 구매의사 여부와 그 이유, 자율주행자동차 사고시 배상책임의 주체와 자율주행자동차의 안정성에 대한 기대에 관하여 설문조사를 실시하였다. 설문분석 결과를 우리나라와 동일한 자동차보험제도를 운영하고 있는 일본에서의 수용성 조사결과와 비교하면서 자율주행자동차 관련 법제도의 바람직한 개선방향을 다음과 같이 도출하였다.
첫째, Level 3 자율주행자동차 사고시 새로운 보험상품이 개발되기 전까지는 현재의 자동차보험제도에 특약상품을 부가하여 판매하도록 한다. 둘째, 통신망 등의 해킹을 통한 사고의 경우에는 현행 정부보장사업과 동일하게 보상한다. 셋째, 소유자와 운전자, 피해자 보호를 위한 자율주행자동차 전용보험상품의 개발이 필요하다. 인적 손해를 담보하는 현재의 자동차보험제도의 방법을 단순화한다. 마지막으로 자율주행자동차의 사고기록장치에 접근할 수 있는 기관을 법적으로 명시하고, 자동차보험자의 구상권 행사가 용이하도록 규정하여야 한다.

영어초록

The Dream of ‘Self-Driving Car’ on the road soon becomes a reality. Most countries, including Korea, have completed the construction of transportation infrastructure and legal infrastructure for the purpose of commercializing limited autonomous vehicles (SAE Level 3) in 2020. Self-driving-car(SDC), which are completely different from the existing cars that have been used for about 100 years, requires urgent maintenance of domestic and international legal systems, and the pace of legal scholars and legislators is speeding up.
As an insurance law scholar, the author questioned whether the SDC could be properly regulated by the current auto insurance system, and argued that a new car insurance system for SDC is necessary. The provision of laws and institutions to be applied to new technologies cannot be separated from the legal consciousness of the members living in this era, and therefore, I believe that research and research on the public's acceptance of autonomous vehicles is necessary.
The author surveyed the Busan citizens about their awareness of self-driving-car, their intention to purchase SDC and their reasons, and the subjects of compensation for autonomous vehicle accidents and the expectation of stability of autonomous vehicles. The results of the questionnaire analysis were compared with the results of the survey on acceptability in Japan, which has the same auto insurance system as in Korea, and the desirable directions for improvement of the legal system related to autonomous vehicles were derived as follows.
First, it is necessary to develop an exclusive insurance to protect owners, drivers and victims in the case of Level 3 autonomous car accidents. Second, until a new insurance product is developed, a special product is added to the current auto insurance system. Third, in the case of accidents through hacking of communication networks, compensation will be made in the same way as current government security projects. Fourth, it simplifies the method of the current auto insurance system that guarantees human damage. Lastly, the agency should be able to legally access the digital tachograph, and make it easy for car-insurers to exercise their right to claims.
