성년후견감독제 강화를 위한 고찰 (Consideration on enhancement of adult guardianship supervision policy)

초록

2013년 7월부터 성년후견제도가 시행되고 있다. 고령화 사회에서 발생하게 되는 여러 가지 문제점들을 해결하고자 하는 세계적 추세에 발맞춘 제도로 고령인구들의 재산적ㆍ복지적 문제를 합리적인 방법으로 해소할 것으로 기대하고 있다. 그러나 선진국 특히 우리와 비슷한 일본의 경우 이 제도의 시행에 따라 다양한 분야에서 문제들이 이미 발생하고 있으며, 사건의 발생 수도 늘어나고 있는 실정이다.
성년후견제도와 관련하여 예견되는 문제는 다양하지만 그 중에서 연구가 거의 전무한 부분이 후견인에 대한 감독법제이다. 특히 성년후견제도는 그 제도의 수혜자인 피성년후견인들은 판단능력이 부족하여 자신에게 주어지는 정당하지 않은 후견에 대해서 제대로 이의를 제기할 가능성이 현저히 낮다는 것이고, 후견인의 임무수행은 그들의 도덕적 양심에 맡겨져 있다는 점이 간과되고 있다는 것이다. 따라서 후견인의 도덕적 해이는 곧바로 피후견인의 권리를 침해하게 되는 결과를 야기하지만 피후견인의 특성상 이를 제재하는 것이 쉽지 않기 때문에 적절한 감독은 반드시 수반되어야 한다. 그럼에도 불구하고 현행 후견인 감독법제는 후견감독인을 임의기관으로 하고 있어 효과적인 감독의 기능을 기대하기 어렵다. 즉, 현행의 법제에 따르게 된다면 후견인에 대한 감독이 제대로 수행되기 어렵다는 것이고, 후견인에 대한 감독이 제대로 이루어지지 않는 다는 것은 결과적으로 판단능력이 부족한 피후견인들의 권익을 보호하는데 한계가 있다는 것을 의미하는 것이다.
본고에서는 피성년후견인의 특징과 후견인의 임무수행의 특징을 기초로 하여 성년후견제도에 대한 해석적 접근방법을 통해서 우리나라에서도 발생할 수 있는 문제점들 특히, 성년후견감독법제에 대한 문제점들을 미리 짚어보고, 성년후견감독제의 강화를 위한 실천적 해결방안을 모색하여 시행에 따른 문제점 발생을 최소화 하여 제도를 정착시키고, 그 결과 최종적으로는 피후견인의 권익을 보호할 수 있는 해결방안을 모색해 보았다.

영어초록

Adult guardianship policy is being implemented since July 2013. The policy has been implemented with the world trends that wishes to resolve various problems occurring in aged society and expected to resolve financial and welfare problems of aged population in reasonable manner. However, in more developed country, especially Japan where shares similarity with Korea, is already experiencing problems from various fields due to implementation of the policy and number of incidents are increasing.
Various problems are expected relating to adult guardianship policy but research regarding supervision policy on adult guardianship has not been previously done. Especially, in adult guardianship policy, the incompetent who is beneficiary of the policy can hardly appeal on inappropriate guardianship provided to them due to their incapability of judgement and that fact that conduct of adult guardianship duty is only depends on morality of guardian is being overlooked. Accordingly, moral hazard of guardian is directly connected to violation of right on incompetent and it must be strictly supervised as it is difficult for incompetent to control it in the given characteristics. Despite the fact, current adult guardianship supervision policy determines supervisor over guard as temporal department which makes effective supervision unlikely. Which means that if is conducted per current policy, supervision on guardian shall not be conducted properly and that shall lead to implication that limitation exists on protecting right and benefit of incompetent who lacks judgement capability.
In this research, with characteristics of adult guardianship and characteristics of task on adult guardianship as foundation, problems that potentially may occur in Korea through interpretative approach regarding adult guardianship policy especially on problems on adult guardianship supervision policy shall be studied and implement policy minimizing problems upon enforcement after consideration of practical solution for enhancement of adult guardianship supervision policy and aims to find solution that could ultimately protect right and benefit of the incompetent.
