형사조정제도에 관한 문제점과 개선방안 (A Study on the Problems and Improvement of the Criminal Mediation System)

초록

형사조정이란 범죄사건의 피해자와 가해자가 중립적인 제3자의 조정 하에 범죄로인해 야기된 피해와 앞으로의 행동계획에 대해 자발적인 합의를 만들어가는 과정이다.
이는 과거의 수사위주, 처벌위주의 관행에서 탈피하여 피해자와 가해자를 형사사법절차에 적극적으로 참여시켜 의견을 진술하게 하고, 피해변제와 관계개선을 최우선 과제로 삼는 ‘피해회복적 형사사법정의’를 구현할 수 있는 제도라 할 수 있다. 그러나 형사조정제도 도입초기의 남고소 폐해를 해결하기 위한 목적이 변질되거나 회복적 사법제도로서의 변화를 모색함에 있어 제도에 대한 자세한 안내가 이루어지지 않아 자발적이고 능동적인 참여가 제한되고 있다. 또한 표준화된 합의기준점이 없어 형사조정의 합의안에 대하여 형평성과 통일성이 문제되고 있으며, 형사조정위원의 자격요건 및 교육프로그램에 대한 부재가 지적되고 있다. 뿐만 아니라 현행 형사조정제도가 법원에서실시되고 있는 민사조정제도에 버금갈 만큼 법률상 엄격한 요건을 갖추고 있음에도 불구하고 법적 구속력이 인정되지 않고 있으며 당사자간의 신속한 분쟁해결과 피해회복을 위해 형사절차상 합의단계를 앞당길 필요가 있으나 입법적 제도적 한계에 직면하고있다.
이에 본고에서는 형사조정제도의 전반적인 발전과정을 개관한 후, 형사조정제도의현행 운영절차를 살펴보고, 실무현장에서 발견되는 문제점에 대한 고찰을 바탕으로 하여 형사조정제도의 효율적 운영을 위한 개선방안을 제시하였다.

영어초록

Criminal case mediation is a kind of process that settles a case between an assailants and criminal victims through the third party’s mediation after mapping out a specific plan to compensate the victims for their damage. Unlike the traditional way to focus only on investigation or punishment-oriented, this would be a system to realize the criminal justice based on the victim restitution by allowing the assailants and victims to actively participate in the criminal justice procedures in order to let them express their opinions and have an improvement of the relationship between them as a top priority.
However, there are some of the restrictions that prevent them from actively and volunteerly participating in the case because the criminal case mediation keeps away from the purpose for introducing it and it is not publicized to the public well in regard to finding a change as a criminal justice based on the victim restitution and settling the negative effects of the frequent lawsuits. Additionally, the lack of a standardized agreement causes the issue of equity and uniformity in the agreement for criminal mediation and the lack of qualification and education programs for the criminal coordination committee is considered as another problem. The legal binding force for the criminal mediation is not regarded from the court even though the system itself has strict legal requirements as like the civil case mediation. In addition, it has faced the legislative and systemic limitations in terms of speeding up the settlements and restoring victims’ damage.
This study is aimed to present better and improved measures for the efficient operation of the system through reviewing the problems currently issued from the field, after considering the overall development process of the system and the current operational procedures in all their bearings.
