초록

지역주택조합은 주택법에 처음 규정되어 지금까지 시행되고 있는 제도이다. 해당 조합과 관련된 규정이 신설될 당시의 제정목적은 일반 분양 주택보다 가격이 저렴하고, 주택청약통장이 필요 없는 등의 장점을 활용하여 해당 지역 거주 주민이 보다 쉽게 주택을 마련하기 위한 방법을 주고자 함이었다.
지역주택조합은 도시 및 주거환경정비법의 재건축과 재개발 사업의 조합에 비교하여 사업진행이 신속하게 이루어진다. 주변시세 보다 낮은 분양가로 내 집을 마련할 수 있는 좋은 기회가 주어지고 있다. 따라서 일반 분양에 비하여 저렴한 가격으로 주택을 보유함으로써 많은 수익을 낼 수 있다는 장점을 가지고 있다.
하지만 지역주택조합은 현 시점에서 지역주택조합에 대한 인식은 실패한 제도라는 인식이 대부분이며 실제 제도의 필요성에 대하여 의구심을 갖게 되는 경우도 다반사이다. 지역주택조합 사업은 그 지역에 살던 주민들이 모여 결성된 조합이라는 하나의 단체에서 출발하는 사업이다.
추진위원회가 결성되면 조합원들의 단체에서 업무대행사에게 시행을 맡기면서 사업이 진행된다. 공공사업이 아닌 민간사업 비법인 형식의 단체가 주택을 마련하기 위해 처음부터 끝까지 경제적으로 발생하는 비용을 모두 조합원들이 책임져야 하는 사업이라고 생각하면 쉽게 이해가 될 것 같다.
이러한 지역주택조합에 대한 문제점을 살펴보면 핵심적인 문제는 추진위원회와 지역주택조합설립, 지역주택조합 사업 운영에 관한 것이다.
추진위화에 관련하여서는 추진위원회를 관리할 만한 공권력이 없기 때문에 발생하는 문제이다. 이를 해결하기 위하여 지역주택조합의 추진위원회와 관련된 내용을 법제화하고 해당 조직의 권한을 제한하여야 한다. 사업계획 수립단계에서 부터 정부 혹은 지방자치단체의 개입이 필요하다. 용역 업체 및 시공자 선정의 투명성이 확보와 더불어 조합 관리체계의 구축이 필요하다.
조합설립인가 신청서류와 관련하여 형식적으로 가입만 한 조합원의 가입을 미연에 방지하기 위하여 조합설립인가 신청서류가 보완되어야 한다. 업무대행자의 자격요건을 강화하여야 한다. 정책적으로 정부가 주도적으로 지방자치단체 등에게 지침 등을 내려 조합원들의 인식 향상을 위한가이드라인을 마련하고 이를 배포하도록 하여 지속적인 관리가 필요하다고 사료된다.

Local housing associations are a system that was first stipulated in the Housing Act and has been in effect until now. The purpose of enactment at the time the regulations related to the association were newly established was to provide a way for residents of the area to prepare housing more easily by taking advantage of the advantages such as being cheaper than general pre-sale housing and not requiring a housing subscription bankbook.
Compared to the combination of reconstruction and redevelopment projects of the Urban and Residential Environment Improvement Act, local housing associations proceed quickly. There is a good opportunity to find my house at a lower sale price than the surrounding market price. Therefore, it has the advantage of making a lot of profit by owning a house at a lower price than general sale.
However, most local housing associations recognize that the perception of local housing associations at this point is a failed system, and it is common to have doubts about the necessity of the actual system. The local housing association project is a project that starts with a single organization called a union formed by residents living in the area.
When the promotion committee is formed, the project proceeds as a group of members entrusts the implementation to the business agency. It would be easy to understand if a non-public business organization is a project in which members are responsible for all economic costs from start to finish to prepare housing.
Looking at these problems with local housing associations, the key problems are the promotion committee, the establishment of local housing associations, and the operation of local housing association projects.Regarding the deregulation of promotion, it is a problem that arises because there is no public authority to manage the promotion committee. To solve this problem, the contents related to the promotion committee of local housing associations should be legislated and the authority of the organization should be limited. Intervention from the government or local governments is required from the stage of establishing a business plan. In addition to securing transparency in the selection of service companies and contractors, it is necessary to establish a union management system.
Regarding the documents for approval of union establishment, the application documents for approval of union establishment should be supplemented in order to prevent members who have only formally joined from joining. The qualifications of business agents should be strengthened. In terms of policy, it is considered that continuous management is necessary by allowing the government to take the lead in preparing and distributing guidelines to improve the awareness of members by giving guidelines to local governments.
