헌법 제31조의 교육원칙과 지방교육자치 (Educational principles and Local educational autonomy on the Article 31 of the Constitution)

초록

헌법상 보장되는 교육제도 중의 하나로서 지방교육자치제도가 여러 법령에 근거하여 시행되고 있음에도 불구하고 여전히 그 실효성에는 의문이 제기되고 있다. 그 문제점은 크게 세 가지로 나누어 볼 수 있는데, 첫째는 주민의 교육자치에의 실질적 참여 부족 문제이고, 둘째는 지방교육자치제도의 핵심이라고 할 수 있는 교육감 선출제도의 문제이다. 그리고 셋째는 지방교육자치의 실질적 실현과 관련된 「지방교육자치법」 조항의 내용적 문제이다. 따라서 본 논문에서는 이러한 세 가지의 문제점에 착안하여 헌법 제31조의 교육원칙에 근거한 해결 방안을 제시하고자 하였다. 먼저, 학부모들의 학교 교육에 대한 통제를 가능하게 하여 주민의 교육에 대한 관심과 지원을 보다 쉽게 유도할 수 있도록 하며, 교육에 대한 지역주민들의 책임 의식을 향상하고 지역의 특수성을 고려한 교육을 가능하게 하여 주민들에게 교육개혁의 의지를 실천할 수 있게 하여야 한다. 다음으로 현행 「공직선거법」은 교육감 후보자에 대한 정당의 공천이나 후보자의 정당 지지 선언 등을 금지하고는 있으나, 교육감 후보자의 특정 정당 지향성을 간접적으로 알 수 있어 정치적 중립성 준수에는 한계가 있으므로, 교육감의 자격요건 중에서 정치적 중립성의 요건을 완화하고 교육적 전문성 요건은 강화하는 방향으로의 개정이 요구된다. 마지막으로 지방의 교육적 특수성을 살려 지방 교육의 발전에 이바지함을 목적으로 하는 지방교육자치제도에서 헌법상의 교육원칙인 ‘교육의 정치적 중립성’ 부분이 빠진 것은 헌법위반에 해당될 수 있으므로 「지방교육자치법」의 개정을 통하여 교육의 ‘정치적 중립성’ 준수를 명시할 필요가 있다.

영어초록

Although the local education autonomy system, one of the educational systems guaranteed by the Constitution is implemented based on various laws, its effectiveness is still questionable. The problems can be largely divided into three : the first, whether residents are actually participating in educational autonomy ; the second, the problem of the superintendent election system, which can be said to be the core of the local education autonomy system ; and the third, the problem of the content of the provisions of the Local Education Autonomy Act related to the actual realization of local education autonomy.
Therefore, this paper presents a solution based on the educational principles of Article 31 of the Constitution, taking into account these three problems.
First, we must enable parents to control school education, so that we can more easily induce residents' interest in and support for education, improve the sense of responsibility of local residents for education, and enable education that takes into account the unique characteristics of the region, so that residents can put their will for educational reform into practice.
Next, although the current Public Official Election Act prohibits political parties from nominating candidates for superintendents of education or candidates from declaring their support for political parties, there are limits to observing political neutrality as it allows for indirect knowledge of a candidate’s political party orientation. Therefore, it is necessary to revise the qualification requirements for superintendents of education to relax the requirement for political neutrality and strengthen the requirement for educational expertise.
Lastly, the omission of the constitutional educational principle of ‘political neutrality of education’ from the local education autonomy system, which aims to contribute to the development of local education by taking advantage of the educational uniqueness of each region, may constitute a violation of the Constitution. Therefore, it is necessary to include compliance with the ‘political neutrality’ of education through revision of the Local Education Autonomy Act.
