수형자의 인권 (Human Rights of Inmates)

초록

본고는 수형자의 인권과 관련된 헌법재판소 판례 및 대법원 판결을 검토한 뒤 그 기본적인 경향을 제시하여 보았다. 또한 헌법재판소 결정 및 대법원 판결에 대한 비판적 견해와 대안적 원칙을 제시하고자 한다. 특히 수형자라는 신분상의 특수성에 따라 인권에 대한 법적 규율이 부여되는 경우에 지켜져야 할 기본적 법원칙을 제시하고자 한다. 헌법에 따르자면 수형자의 인권도 헌법 제12조 제1항에 나오는 적법절차원칙에 따라 보장되어야 한다. 수형자 또한 우리의 이웃이고 더불어 살아가는 사람들이다. 교도소에 입감된 수형자들도 비록 죄수복을 입고 수형생활을 영위하고 있지만 기본적으로 국가를 구성하고 있는 시민으로 볼 수 있다. 따라서 국가는 수형자에게 시민의 한 사람으로서 갖는 권리를 충분히 보장해야 한다. 하지만 현실은 아직 이러한 원칙에 익숙하지 못하다. 수형자에 대한 인권의 제한이 목적의 정당성, 방법의 적정성, 피해의 최소성과 법익의 균형성을 의미하는 과잉금지의 원칙에 위배 되어서는 안 된다.
수형자는 구금의 성격상 자유를 제한받기 때문에 특히 인권이 침해되지 않도록 각별한 주의를 기울여야 하며, 수형자의 인권신장을 위하여 많은 제도개선을 추진하여야 한다. 뿐만아니라 법치국가원리에 따른 법원칙도 수형자에 대해서도 적용된다. 또한 수형자 자신의 인권을 침해 받은 경우에는 권리구제수단을 활용할 수 있어야 한다. 현대 입헌주의 법치국가에서 기본권의 최대한 보장과 그 제한에 관한 사법통제의 원칙이 수형자를 포함한 모든 국민에 대하여 예외 없이 적용되어야 한다. 이에 대해 본고에서는 상기 내용에 대한 검토를 한 뒤에 필요적 가석방을 수형자의 권리로써 보장하고, 수형자의 사회적 복귀권을 확대해야 함을 논고하였다.

영어초록

This article suggests presents the basic trends after considering the Constitutional Court case and the Supreme Court decisions which are related to the human rights of the inmates and I also have suggested critical views and alternative principles for the Constitutional Court decisions and Supreme Court decisions. In particular, I will present the basic legal principles to be followed in cases which legal discipline is given to human rights according to the distinctiveness of the status of inmates. According to the Constitutional Law, the human rights of inmates should also be guaranteed in accordance with the due process principles set out in Article 12 (1) of the Constitutional Law. Inmates are also our neighbors and we live together with them.
Inmates who were sent to prisons are also seen as citizens who are basically constituting the state, even though they are guilty and stay in prison with inmate clothes. Therefore, the state must fully guarantee the right of the inmates to be citizens. But the reality is not yet familiar with these principles. The restriction of human rights to inmates should not be contrary to the principle of excessive prohibition, which means the legitimacy of the purpose, the adequacy of the method, the minimum of the damage and the balance of the legitimate interests. Because the inmates are limited in their freedom of nature, they must pay special attention to prevent infringement of human rights and should change the system to improve the human rights of inmates. In addition, the theories and principle of the rule of the law also apply to inmates.
Also, if a inmate is infringed by his or her human rights, he or she should be able to use the systems which recovers the infringements.
The principle of judicial control over the maximum guarantee and restriction of basic rights in the law of the Constitutional Countries should be applied without exception to all citizens including inmates. After reviewing this, it was suggested that the mandatory parole should be guaranteed as inmates’ rights and the social return of inmates should be expanded.
