성행위에 있어 동의의 판단과 범죄화에 관한 일고찰 (A Study on the Judgment of Consent and Criminalization of Sexual Intercourse)

초록

성범죄는 성적자기결정권의 침해로 발생하며 오랜 시간 형법 및 특별법에서는 폭행과협박을 수반하여 성적 행위에 나아간 경우를 기본적으로 규정하고 있었으나 일정 시점이후 폭행과 협박의 좁은 해석에 대하여 많은 비난이 있어 왔으며 명확한 폭행과 협박이없는 성적행위라도 가해자와 피해자의 제반상황을 감안하여 동의여부로 성범죄를 판단하여야 한다는 새로운 패러다임이 제기되고 있으며 본고에서는 비동의간음죄와 스텔싱을중심으로 고찰하였다. 두 유형은 많은 부분에서 맞닿아 있으며 무엇보다 성적자기결정권의 침해라는 점에서같이 취급되는 경우가 많으나 분명 구분되어야 한다고 판단된다. 스텔싱은 콘돔 등 기구의 사용을 조건으로 성관계가 진행된 것을 이후 피해자의 의사에 반하여 이를 제거하거나 훼손하였기 때문에 분명 문제가 되지만, 비동의간음죄는 규정의 필요성에는 충분히 공감하지만 동의를 어떻게 해석할 것인가에 근본적인 문제가 있기 때문이다. 즉 스텔싱은콘돔 등의 기구를 제거한 부분에 명백한 불법성을 연결시킬 수 있지만 비동의간음죄의경우 성행위의 전단계와 성행위와 관련된 수많은 과정과 행위를 감안하면 동의 여부를명확하게 판단하는 것이 가능한지 의문이다. 그리고 스텔싱의 경우 대부분의 견해들이 성관계 이후의 결과적 문제점을 바탕으로 범죄화 하여야 한다고 주장하나 스텔싱에서 명확하게 판단해야 할 부분은 행위자체의 문제점이다. 즉 임신과 출산에 있어서의 성적자율성과 성병의 위험 등은 충분히 감안되어야하지만 스텔싱에서 성적자율성은 콘돔 등 도구의 사용에 대한 합의가 지켜지지 않은 것에 초점을 두어야 한다고 판단된다.

영어초록

A sex crime occurs when the sexual self-determination is violated. In the criminal law and special law, the sex crime has been basically prescribed for a long time as a case of sexual intercourse accompanied by violence and threat. However, there have been many criticisms on the narrow interpretation of violence and threat after a certain period of time. According to the newly-rising paradigm, a sex crime should be judged based on the matter of consent by considering all the circumstances of assailant and victim even when the sexual intercourse has neither clear violence nor threat. Thus, this thesis considered it focusing on sexual intercourse without consent and stealthing.
Both types are connected to each other in many aspects. Even though they are mostly handled equally in the aspect of the violation of sexual self-determination, they must be clearly distinguished from each other. In the middle of sexual intercourse under the condition of using a contraceptive such as condom, the contraceptive is removed or damaged against the victim’s intention. This is called stealthing, and it could be brought up as a problem. However, in case of sexual intercourse without consent, there is a fundamental problem of how to interpret the consent even though everyone fully empathizes with the necessity of regulation. In other words, the stealthing could be connected to the clear illegality in the aspect of removing a contraceptive like condom. In case of sexual intercourse without consent, it is questionable to clearly judge the matter of consent when such numerous processes and acts related to sexual intercourse are considered.
And in case of stealthing, most of the opinions argue that it should be criminalized on the basis of consequential problem after sexual intercourse. But what should be clearly judged in stealthing is the problem of the act itself. In other words, even though we should fully consider the risk of sexually-transmitted diseases and sexual self-determination in relation to pregnancy and childbirth, the stealthing does not keep the consent of using a tool like condom, which could be led to the rational legislation in the future.
