국회의원의 지역대표성과 국가이익 (Local representation of national assembly members and National Interest)

초록

본 연구는 지역을 기준으로 선출된 국회의원이 본인 지역구의 이익을 위해 입법, 예산 및 정책 활동을 하는 것이 과연 헌법적으로 용인될 수 있는 것인가에 대한 의문에서 출발한다. 우리 헌법 제46조 제2항은 국회의원의 자유위임(무기속위임)을 인정하면서도 국가이익을 우선하라는 한계를 정하고 있다. 국회의원은 입법 등의 의정활동에서 자신의 지역구의 이익과 국가이익이 갈등하는 상황을 무수히 만나게 된다. 재선이 최고의 행동 동기인 현역 국회의원들에게 우리 헌법의 조항은 먼 나라 이야기가 된다. 재선을 위해서 언제나 국가이익보다는 자신의 지역구 이익을 우선시하게 되는 것이다. 게다가 반헌법적인 행위를 오히려 지역을 위해 예산을 확보했다는 식으로 자랑한다. 253개 지역구 이익의 합이 대한민국이라는 민주공화국의 전체 이익과 합치되지 않음은 자명하다. 헌법재판소는 그 기준을 강화하는 추세지만 투표의 성과가치 평등은 지역대표성이라는 개인이 아닌 집단과 공동체의 강조라는 전근대적인 요소에 가려져 있다. 지역대표성은 지역의 이익 추구를 당연시하는 논리적 도구로서 기능한다. 대한민국의 모든 국민을 기속하는 법률을 만들 수 있는 입법권은 국회에 전속되어 있고 국회는 200인 이상의 국회의원으로 구성된다. 각자의 국회의원은 무엇이 국가의 이익인지 고민할 필요도 없이 내 지역의 이익이 무엇인지만 고민하면 된다. 이렇게 주장된 개별 이익은 합쳐져 국가이익으로 오해된다. 이렇게 낭비되는 국가 예산을 막아줄 최후의 보루인 비용 대비 편익 분석인 예비타당성 조사도 흔들리고 있다. 이제, 지역대표성이라는 형체 없는 괴물을 벗어나 투표의 성과가치의 평등을 바탕으로 한정된 재화를 국가이익이라는 유일한 기준에 맞추어 권위적으로 배분할 수 있는 기준을 세울 때이다. 시간이 많지 않다.

영어초록

This study starts from the question of whether legislators, budgetary and policy activists for the benefit of their constituency can be constitutionally approved by a local councilor. Article 46 (2) of the Constitution stipulates the limitation of the national interests, while recognizing the free delegation of the members of the National Assembly.
Members of the National Assembly meet in myriad activities such as legislative activities to find conflicts between the interests of their districts and their national interests. The provisions of our Constitution are a distant country's story to active members of parliament who are the best motivators for re - election. For re-election, it always gives priority to the interests of the local people rather than to the national interests. In addition, we boast that we have secured a budget for the area rather than anti-constitutional acts. It is clear that the sum of 253 regional interests is not in line with the overall interest of the Republic of Korea.
The Constitutional Court tends to strengthen its standards, but the performance and equality of votes is overshadowed by the premodern elements of community and community emphasis rather than individuality of local representation. Local representation serves as a logical tool to take advantage of local interests. The legislative power to create laws that will rule all the people of the Republic of Korea is reserved to the National Assembly, and the National Assembly consists of more than 200 members of the National Assembly. Each member of parliament has no need to worry about what is the interest of the state, but only worries about the interests of the region.
These claimed individual interests are combined and misinterpreted as national interests. A preliminary feasibility study, a cost-benefit analysis, is also shaken, which is the last safeguard against the wasted state budget. Now, it is time to set a criterion for authoritatively allocating limited goods to the sole standard of national interest, based on the equality of the performance values ​​of the votes, beyond the formless monsters of local representation.
