우리나라에서의 민영교도소의 확대방안 (Measure for expanding private prisons in our country)

초록

우리나라에서도 드디어 민영교도소 도입을 위한 법제정이 이루어졌고, 최초의 민영교도소인 아가페 소망교도소가 개소를 앞두고 있다. 민영교도소의 도입배경은 기본적으로 심화된 교정시설의 부족에 대한 해결책과 교정행정에 대한 패러다임의 변화라고 볼 수 있다. 이러한 상황에서 종래의 민영교도소 도입에 대한 찬반론은 민영교도소의 성공적 운영을 위한 방법과 민영교도소 확대문제로 그 논의의 초점이 이동되어야 할 것이다. 그런데 우리나라에서 민영교도소 제도가 도입된 지 10년이 지났지만 초기에 예상했던 진행이 답보상태에 있는 것이 현실이므로, 새로운 동력이 필요한 시점이다. 이제는 종교교도소의 한계 극복을 위한 민영교도소의 또 다른 형태인 영리교도소의 개소를 적극 추진할 필요가 있다. 종교교도소와 영리교도소의 병행설립과 경쟁을 통한 비교를 통하여 우리나라에서 적합한 민영교도소의 방향을 모색할 수 있을 것이다. 영리교도소 도입을 위한 최대의 건림돌은 재정문제 특히 수 백억원에 달하는 교도소 부지확보 및 건물신축비용 문제이다. 이 문제를 해결하여야만 우리나라에서도 영리교도소 설립이 가능할 것으로 보인다. 종교적인 기부나 비현실적인 재정지출을 강요하는 현행법으로서는 해결이 불가능하므로 조속한 법개정을 통하여 민영교도소 확대를 위한 기반을 마련할 필요가 있다.

영어초록

Private prison system was introduced in the middle of reflection on prison administration which was under management by the state until recently and in the midst of wind of privatization of public sector since 1980s across the world and attitude of acceptance of private prison system became a majority opinion. Many countries including England, Japan and Brazil are operating private prisons and elicited evaluation of success and by virtue of such positive evaluation opening new private prisons is expanding. In our country also eventually introduction of private prison system was legislated. The first private prison Agape Somang Prison is about to open shortly. Background of introducing private prison to our country was motivated by need for solving worsening shortage of prison facilities and changed paradigm on prison administration. Under such circumstances the erstwhile focus in the debate on pro and con of introducing private prison system should be shifted toward the direction of method for successful operation of private prison system and issue of expanding the system. Although 10 years passed since introduction of private prison system reality it is still marking time without no more progress thus new driving force is required. Successful operation of Agape Prison shall become a crucial linchpin which would spell success or failure of our private prison system hereafter. Accordingly program at the stage of diverse acceptance stage of Agape Prison and post acceptance stage and supplementation through trial operation are evaluated very highly. At such juncture there is need for working on opening of for-profit prison which is another form of private prison in order to overcome limitation of religious prison. Through comparison by establishment of and competition between religious prison and private prison we may seek direction for private prison which is appropriate to our country. The biggest obstacle in introducing for-profit prison is financial problem viz. securing land for the prison and construction of new buildings which cost billions. Seemingly it will be possible to establish for profit prison in our country only when this problem is overcome. Under current law which compels religious donation or unrealistic donation solution of such problems will be impossible thus through earliest revision of the law it is necessary to prepare grounds for expanding private prison system further.
