고령소비자 보호를 위한 법제개선방안 (Improvement on Laws for Protection of theElderly Consumenrs)

초록

일반적으로 고령자는 생애주기적 특성상 정신적⋅신체적 변화로 인하여 거래에 대한 판단능력과 교섭능력이 저하되는 경향이 있다. 또한 고령자의 지식은 시대에 뒤떨어지기 때문에 급변하는 사회현상에 빠르게 대처할 수 없다는 특성을 갖는다. 이와 같이 거래에 대한 합리적인 판단을 방해하는 고령자의 상황들은 고령자를 취약한 계층에 놓일 수밖에 없게 만든다. 그러한 취약성으로 인하여 고령자들은 그들의 은퇴 후 재산을 노리고 접근하는 악덕 사업자들의 주요 타겟이 될 수밖에 없다.
다른 어느 나라보다 고령화가 빠르게 진행되고 있는 우리나라의 경우에 고령자에 대한 보호문제는 가장 중요한 사회문제 중에 하나라고 해도 과언이 아니다. 이러한 문제를 해결하기 위해서는 거래안전의 측면에서 고령자를 특별하게 보호해야 하는 이유에 대한 정당성 확보가 우선적으로 이루어져야 한다.
고령자의 판단능력은 개개인마다 다르기 때문에 사법상 고령자를 보호하기 위한 특별한 제도적 장치를 마련하는 것은 매우 어려운 일이다. 그럼에도 불구하고 고령소비자가 피해를 입었을 때, 적용할 수 있는 민법상 보호수단은 성년후견제도에 의한 보호를 생각해 볼 수 있다. 우리 민법에도 성년후견제도가 도입이 된지 2년이 다 되어가지만 아직 그 활용도가 높지 않은 것이 사실이며 당해 제도가 고령자를 효율적으로 보호하기 위한 법적 장치로 기능하기 위해서는 법제도의 안정적인 구축을 위한 새로운 개선방안이 필요하다. 성년후견제도 이외의 민법상 구제수단으로 의사무능력을 이유로 한 계약의 무효주장, 불공정한 법률행위를 이유로 한 계약의 무효주장, 착오나 사기⋅강박을 이유로 한 계약의 취소를 생각해 볼 수 있다. 민법상 구제수단 이외에 사법적 구제수단은 소비자 거래 관련 특별법에서 청약철회권의 행사를 통하여 고령소비자의 보호가 가능할 것이다. 하지만 이러한 방안들도 고령소비자를 보호하기에는 한계가 존재하는 것이 사실이다.
고령사회의 진입을 목전에 두고 있는 현시점에서 보다 효율적인 고령소비자의 보호수단을 확보하기 위하여 본고에서는 고령자의 거래에 있어서 법적 쟁점들을 다루는 것을 목적으로 하였다. 특히, 고령소비자를 보호하기 위해서 가장 바람직한 방법은 소비자거래 관련 특별법에 고령소비자를 특별히 보호할 수 있는 규정을 두는 방법일 것이다. 구체적으로는 소비자거래 관련 특별법에 고령소비자에게만 적용될 수 있는 기간이 확대된 청약철회권 규정을 신설하고, 손해배상청구권의 요건을 완화시켜주는 규정을 신설하는 방안을 마련해야 한다. 또한 고령소비자를 대상으로 거래하는 사업자에게 보다 엄격한 설명의무와 정보제공의무를 강화하는 방안을 고려해야 할 것이다.

영어초록

Elderly consumers tend to decrease the negotiation skills and judgement to deal with operators on the nature of life cycle because of the physical and mental changes. Because the knowledge of the elderly is obsolete, they can´t respond quickly to rapidly changing social phenomena characteristic. In the situation of the elderly to interfere with rational judgment about such transactions, the elderly people are forced to be placed in the vulnerable groups. Due to such vulnerability, They are bound to be the main targets of unscrupulous operators seeking to access the property after their retirement.
In South Korea, which is aging faster progress than other countries, protection issues for the elderly is one of the most important social problems. In order to solve this problem, to ensure the justification for why should particularly protect the elderly in terms of the transaction safety must be made first.
Because the judgement of elderly is different for each individual, it is so difficult that establishes special civil system to protect the elderly. Nevertheless, if the elderly consumer suffers damage, civil protection that can be preferentially applied is the method according to the adult guardianship system. The adult guardianship system was introduced almost two years in Korea. In fact utilization of the system is still low. In oder to function the legal system as a legal device efficiently to protect the elderly, the new system improvements for building a reliable legal system is needed. In addition to the civil protection ways to protect the elderly as consumers, there are claiming invalidity of the contract by reason of devoid of mental capacity, claiming invalidity of the contract by reason of unfair laws acts, cancellation of the contract due to error and fraud or obsessive compulsive etc. In addition, elderly consumers are protected to the exercise of the right of withdrawal on special laws related consumer transactions. Despite this legal protection methods, there is a limit also to protect elderly consumers.
In order to ensure more effective protection of elderly consumers, This paper was aimed at dealing with legal issues in the transaction of the elderly. In addition, it presents more efficient ways to secure the protection of elderly consumers. In particular, the most desirable way to protect elderly consumers is to establish special provisions in special laws related consumer transactions to protect the elderly consumers. For examples, the new provisions on the right of withdrawal to be applied the elderly consumers will have to establish. And It will have to be new provisions that alleviate the requirements of the damages claim. It will also consider ways to reinforce the stringent than the obligation to instruct and provide information to operators which aimed to deal with elderly consumers.
