재산범죄의 객체로서 재물과 재산상 이익 (Dichotomy of Property and Pecuniary Advantage)

초록

본고는 형법상 재산범죄의 객체로서 재물과 재산상 이익의 구분법 내지 양자의 관계에 대해 양자의 엄격한 이분법을 비판하는 기존의 선행연구들과 달리 그러한 이분법에 기초한 대법원 판례의 입장을 모순없이 정합적으로 이해해 보려는 해석론을 제시해 보고자 하였다. 기존의 평석과 연구들은 대체로 재산범죄의 객체로서 재물과 재산상 이익의 구별실익을 한편으로는 긍정하면서도 다른 한편으로는 양자의 엄격한 구분법에 의거하여 적용법조를 결정하게 되면 불법의 실질을 제대로 반영하지 못하는 결과를 가져올 수 있으므로 양자의 관계를 택일관계가 아닌 특별관계, 즉 재산상 이익에 재물이 포함되는 관계-단, 그 역은 성립하지 않음-로 이해할 것을 제안하고 있다. 그 이유는 만약에 엄격한 구분법을 따르게 되면 판례의 태도에 모순이 생기기 때문이라고 한다. 하지만 본고의 입장에 의하면 대법원 판례의 태도가 재산범죄의 객체로서 재물과 재산상 이익의 구분에 있어서 원칙-예외 법리를 통해서 일관성을 지닌 것으로 정합적으로 해석할 수 있고, 따라서 그러한 한에서 모순점은 상당부분 해소될 수 있는 것으로 평가될 수 있다. 그렇다면 재물-재산상 이익이라는 기존의 이분법은 여전히 재산범죄의 해석에 있어서 유의미한 의의를 지닐 수 있으며, 이에 대한 비판과 개선책의 제안은 신중을 기할 필요가 있음을 제시해 보고자 하였다. 다만 이러한 결론은 잠정적인 것이며 더 많은 사례의 검토를 통하여 보완될 필요가 있을 것이다.

영어초록

On May 17, 2018, the Supreme Court declared that “In a real estate sale contract, where only a down payment is made, either party to the real estate sale contract can be freed from the binding force of the contract by relinquishing the down payment or refunding twice the amount of the down payment received. However, once the performance of contract has reached a full-fledged stage with the delivery of an intermediate payment, the seller may not be exempt from the obligation to transfer the ownership of real estate to the buyer, unless the contract is voided or rescinded. Therefore, where a contract reaches this stage, the seller owes a fiduciary duty to the buyer, in which the seller is obliged to cooperate with the buyer in the buyer’s preservation of property by protecting and managing the buyer’s pecuniary advantage. From that moment, the seller becomes “a person who administers another’s business” as stated in the crime of breach of trust. Where the seller in such a position, prior to transferring the ownership of real estate to the buyer in accordance with the contract, disposes of the said real estate to a third party and completes registration thereof in the name of the third party, such an act impedes the buyer’s acquisition or preservation of the real estate and the seller is deemed to have abandoned the fiduciary relationship it forged with the buyer, and the crime of breach of trust is established.” The decision aroused fierce and great controversy in legal academia. Some critics argued that in this case the crime of breach of trust cannot be established, for the object of the crime of breach of trust is not property, but pecuniary advantage. Other commentators suggest that rigid dichotomy between property and pecuniary advantage should be abandoned or changed, for the dichotomy cannot be sustained any more in the real cases.
However, the paper tries to analyze the unreasonableness of the arguments against the decision or the dichotomy and to refute them, concluding that we can regard the decision and some other decisions regarding the dichotomy consistent and coherent.
