헌법상 지방교육자치의 기본원리 (Basic Constitutional Principles of Local Educational Autonomy)

초록

본 연구는 지방교육자치에 대한 공법학적 접근을 시도하여, 헌법과 지방교육자치법제를 바탕으로 지방교육자치 전반에 걸쳐 적용할 수 있는 지방교육자치제도의 일반적인 기본원리를 도출하여 향후 지방교육자치를 둘러싼 각종 논의에 적용할 수 있는 공법적 판단 근거를 제시하고자 한다.
이에 헌법상 교육의 기본원리를 이념적 기초로 하고, 국민주권·민주주의, 지방자치, 교육자주’라고 하는 세 가지의 헌법적 가치를 바탕으로 하여, 헌법규정에 내포된 지방교육자치의 5대 기본원리를 도출하였는데, 자주성의 원리, 전문적 관리의 원리, 정치적 중립성의 원리, 민주성의 원리(주민참여의 원리), 지방분권의 원리가 그것이다.
그 구체적인 내용을 제시한다면, 자주성의 원리에서는 교육의 내용과 방법의 자주적 결정 및 교육행정기관의 연계성 및 행·재정적 지원 확보, 전문성의 원리에서는 교육의 전문적 관리와 교육행정의 전문적 관리를 들 수 있다. 그리고 정치적 중립성의 원리에서는 교육내용의 중립성과 교사의 중립성, 민주성의 원리에서 주민의 대표성 확보, 대표자 선임절차의 공정성, 교육정책 결정과정에서 주민의 의사반영, 지방교육에 대한 책임성, 행정조직의 민주적 운영 등을 제시할 수 있다. 또한 지방분권의 원리에서는 지방의 교육적 특수성 반영, 교육의 지역적합성, 지방의 균형발전을 열거할 수 있다.

영어초록

This paper looks into the local educational autonomy system from the perspectives of public law with a view to deriving general principles that are applicable to the overall educational system and can serve as a set of legal criteria for future discussions of local educational autonomy.
From the basic educational principles of the constitution and three fundamental constitutional values such as the sovereignty of the people (or democracy), local autonomy, and autonomy of education, the following five principles of local educational autonomy are derived:(ⅰ) the principle of independence (ⅱ) the principle of professional management (ⅲ) the principle of political impartiality (ⅳ) the principle of democracy (or resident participation)and(ⅴ) the principle of decentralization.
More specifically, the principle of independence relates to the independent decisions of the local educational authorities for the content and method of education, close association of educational and administrative institutions, and secure administrative and financial support. The principle of professional management is concerned with the professional quality of educational and administrative management, and the principle of political impartiality with the political neutrality of the teachers and educational content.
The principle of democracy has to do with the legitimacy of the educational authorities justly derived from the residents, equitable procedures for the selection of the resident representatives, reflection of the residents' wishes in the decision-making processes, responsibilities of the educational authorities for local education, and democratic management of the administrative organizations. Finally, the principle of decentralization is relevant to such issues as reflection of the local particularities in education, regional appropriateness of the educational system, and balanced regional development.
