부동산경매절차에서 채권의 일부청구에 관한 연구 (Research Concerning the Partial Claimof a Claimby Auction-of-real-estate Procedure)

초록

부동산에 대한 강제경매의 신청은 채권자가 채무자에 대하여 가지는 금전채권에 관한 집행권원에 기하여 채무자 소유의 부동산을 경매하여 그 대금으로 채권의 변제를 받기 위하여 집행법원에 대하여 경매절차의 개시를 구하는 소송행위의 일종이다. 이러한 경매신청을 하여 그 채권 전액을 기준으로 하여 배당을 받을 수 있지만, 채권의 일부만을 청구금액으로 하여 경매를 신청할 수도 있음은 처분권주의 하에서 당연한 것이다. 이러한 경우에 배당의 기초가 되는 금액은 경매신청시의 청구금액으로 확정되므로 청구금액을 확장할 수 없다고 한다면 신청채권자의 입장에서는 약간의 세금절약, 또는 그 밖의 사정으로 인하여 일부 경매를 신청하였다가 나머지 채권의 만족을 얻지 못한 채 저당권이 말소되는 큰 불이익을 입게 될 것이고, 반면 청구금액의 확장을 무제한 허용하게 되면 배당에 참가한 후순위권리자 기타 채권자의 이익을 해하게 될 것이다. 필자는 강제경매신청시 신청서에 기재한 청구금액이 배당채권으로 확정된다는 취지에서 일부청구를 경매절차 중에 잔부청구의 부분을 확장할 수 없다는 견해에 찬동할 수 없다. 신청된 경매절차에 편승하여 배당에 참가한 배당요구자들은 배당요구서에 기재한 청구금액을 배당요구의 종기(첫 매각기일 이전으로서 집행법원이 정한 때, 민집 제84조 제1항)까지 확장하여 배당요구가 가능하고, 판례도 강제경매신청권자에게 배당기일 까지 잔부청구에 대하여 배당요구가 가능하다는 취지인 바, 사실상 청구확장이 허용되고 있기에 확장이 가능하다고 적극적으로 해석하고자 한다.
필자는 담보권실행의 경매에서 목적부동산을 경매하여도 채권전액의 만족을 얻을 가능성이 없다고 생각될 경우에 만족을 얻을 수 있는 금액의 한도로 감축하여 채권금액의 일부를 신청을 할 수 있다고 생각한다. 결국 일부청구에 의한 경매신청은 잔부청구의 포기가 아니라 필요에 따른 권리자의 정당한 권리행사를 인정하는 취지를 법규로 규정하였고, 따라서 청구확장이 가능하다는 결론이다.

The compulsory-sale-by-auction application to real estate is a kind of theprocedural act which auctions off the real estate of obligor possession by the debtskilled physician about a money claim, and requires the start of auction procedureof the method of a receptacle, and an execution court for payment of a claim bythe loan. 59)Although such an auction application can be made and a dividend can bereceived on the basis of the claim total amount, it is the amount billed in a part ofclaim, and it is also a thing natural on a right-of-disposal principle that it canapply for auction.
In such a case, the amount of money which becomes the foundation of adividend is decided by the amount billed at the time of an auction application, If itis said later that the amount billed cannot be extended, in an application creditor'sposition, the large disadvantage by which a mortgage is erased applying for auctionin part and being unable to obtain satisfaction of the remaining claims according tosome tax saving and other situations will be suffered.
If unrestricted permission of the extension of the amount billed will be carriedout, the profits of the ranking right holder and the other next creditors whoparticipated in the dividend will be injured.
The writer cannot consent to the view that the portion of a remainder claim of aclaim into auction procedure is inextensible in part with the meaning that theamount billed written in the application form at the time of acompulsory-sale-by-auction application is decided with a dividend claim.
A distribution demand can do the amount billed written in the distribution demanddocument, even a thing extends the distribution demand person who took the advantage of the auction procedure for which it applied, and participated in thedividend, and a distribution demand is possible for them, A judicial precedent alsothinks that it will interpret positively for the right person of acompulsory-sale-by-auction application to be allowed the reason which is themeaning that a distribution demand is possible, and claim-on fact extension to aremainder claim till a distribution period day, and for it to be able to extend.
Even if a writer auctions off a subject property by auction of lien execution,when it is thought that satisfaction of the claim total amount must have beenobtained, he thinks that it reduces in the limit of the amount of money which canobtain satisfaction, and an application can do a part of claim amount of money.
After all, the auction application by a part of claims specified as the regulationthe meaning which accepts a right holder's just exercise accompanying the notabandonment but necessity for a remainder claim, therefore is the conclusion thatextension of a claim is possible.
