초록

현재 인터넷이 인간처럼 스스로 지능을 갖는다는 웹 3.0의 시대를 바라보면서 인터넷을 통한 디지털 기술의 환경은 지속적이며 급속도로 발전하고 있다.
이러한 디지털 기술의 발달로 인하여 여러 분야에 순기능도 있지만, 이에 발맞추어 필연적으로 역기능도 급속하게 증가하고 있는 실정이며 컴퓨터를 통한 새로운 범죄 방법, 기술들은 언제, 어디서나 쉽게 인터넷의 접근을 통하여 범죄자에게 악용되고 있다. 특히 최근에는 경제활동, 행정서류 등 법적 문서도 디지털화 되고 있다. 개인, 기업, 정부기관 등 모든 영역에서 생산되는 자료는 기본적으로 컴퓨터 작업으로 이루어지고 있으며 기존의 자료도 디지털 자료로 변환되고 있다.
그러나 아직까지 우리의 현실은 디지털 범죄에 관한 구체적인 법률이 마련되어 있지 않아 많은 법적 다툼이 제기될 가능성이 높아지고 있다. 이러한 법적 미비가 결국 기본권 침해, 특히 사생활 침해 문제로 이어지지만, 수사를 하는 수사기관이나 수사를 받는 당사자도 이에 대하여 전혀 인식을 하고 있지 못하고 있는 것이 현재의 실정이다.
이 논문은 미국의 수사기관에 의한 디지털 범죄 수사시에 헌법상 보장된 기본권 침해로 특히 수사시관이 디지털 증거를 수집함에 있어 야기되는 타인의 사생활 공개·침해 문제에 대하여 고찰하였다. 현재 우리나라에서는 수사기관이 디지털 범죄와 관련하여 개인의 기본권 침해 문제에 관하여 논의 및 관련된 사례가 없는 실정이다. 이러한 문제를 해결하고자 미국은 기존 전통적인 범죄사례와 판례에서 이를 도출하여 디지털 범죄에 적용하였다. 따라서 이에 대한 구체적인 검토가 앞으로 우리나라의 입법방향을 제시할 수 있다고 생각한다.

영어초록

Throughout the 20th and 21st centuries, Internet is one of the greatest inventions of mankind. Internet web environments have been advanced from the stage of collecting, presenting, and transferring digital information, Web 1.0, to the current generation of Web 2.0, enabling users to produce and share information more easily. The environments of digital technology through Internet will be enhanced and developed further to the extent of advanced Web 3.0 with the main function of self-intelligence.
Although digital development has positive functions in a wide variety of the fields, some mal-functions of digital development have inevitably emerged. Easy access to and frequent use of computers by criminals have been accelerating new types of crime methods and techniques in the modern society, because of mis-use or abuse of computer itself and flooding information on the Internet.
In particular, legal and administration documents in enterprise and government sectors are recently digitalized as well. Any data produced by individuals, corporations, and government branches have basically been produced and stored on computer. Almost all of historical information and data have also been digitalized.
Studies the conflicts derived from violations of granted constitutional rights for individual during the collection of digital evidence by law enforcement such as violating individual privacy.
Currently, there has not been any argument or case that indicates violation of individual privacy relative to the investigation of digital crime by law enforcement in Korea. To solve this kind of conflicts, American traditional crime cases and precedents on digital crime were applied. So, this chapter scrutinizes possible directions of legislation in Korea on this specific subject.
Either digital crimes or cases related to the evidence have not taken place that many in Korea up to now. However, there was one case related to digital evidence at Seoul District Court in April 2007. It is obvious that there will be gradual increase in the number of such cases. Thus, researches and embodied laws must be established for law enforcement to study a variety of related cases relative to the constitutional rights for individuals, which will occur while investigating digital crime.
The following research and legislation of digital crime by law enforcement will surely contribute to resulting in the citizens’ less violation and the security of maximum individual privacy.
