빅데이터 환경과 개인정보 보호방안 (Big Data and Personal Information Protection)

초록

미래학자들은 ① 정보통신기술(ICT)과 인공지능(AI)의 발전으로 인한 4차 산업혁명, ② 청·장년층의급격한 감소와 노년층의 증가로 인한 인구구조 변동, ③ 지구온난화로 인한 자연환경의 급속한 변화 등이 인류의 운명을 결정할 것이라고 한다. 이 중에서도 향후 경제발전과 일자리 창출을 위해 가장 결정적인 영향을 미치게 될 요소는 바로 4차 산업혁명이다.
지난 2016년 1월 세계경제포럼(WEF) 회장 클라우스 슈밥(Klaus Schwab)에 의해 주창된 ‘4차 산업혁명이론’에 따르면 증기기관이 촉발한 1차 산업혁명(기계화), 전기를 활용한 2차 산업혁명(대량생산), IT기술로 대표되는 3차 산업혁명(정보화 및 자동화)에 이어 기술과 산업 간의 융･복합현상이 산업구조의 근본적인 변혁을 초래한다고 한다.
모든 사물 안에 컴퓨터 칩이 내장되고, 이를 통해 개인에 대한 정보들이 실시간으로 수집･분석되면서언제, 어디서나 인간의 모든 것을 관리･감독할 수 있는 빅 브라더(Big Brother)의 시대가 도래하였다. 미래에는 빅데이터를 활용하여 사용자의 행동을 미리 예측하고 대처방안을 마련해 산업의 경쟁력이 강화되고, 생산성 향상과 혁신이 가능해질 것이다.
이렇게 정보사회에서 디지털 정보가 비약적으로 증가하고 정보간의 집적과 분석이 단기간에 가능해지면서 가장 문제가 되고 있는 분야가 바로 개인정보보호의 문제이다. 정보화사회에서 정보의 오･남용, 과도한 정보유통, 개인정보 유출 등으로 인한 국가와 개인의 손실이 기하급수적으로 증가하고 있다.
특히 빅데이터 기술을 통해 비식별화된 개인정보를 해킹할 경우, 개인의 신상정보를 타인이 마음대로도용할 수 있는 등 자신도 모르는 사이에 민감한 정보가 노출되어 매우 불리한 결과를 야기할 수 있는위험성이 증가하였으며, 그에 비례하여 개인정보보호를 위한 입법적 요청도 커지고 있다.
개인정보자기결정권은 자신에 대한 정보가 언제 누구에게 어느 범위까지 알려지고, 또 이용되도록 할것인가에 대해서 정보주체가 스스로 결정할 수 있는 권리로서, 정보화사회에서 필수적인 권리로 자리매김해 왔다. 반면, 최근에는 빅데이터시대를 맞이하여 정보주체의 개인정보보호권이라는 측면만이 아니라, 정보재로서의 활용가능성도 제고해야 한다는 견해가 제기되고 있다.
최근 정보화의 급속한 발전으로 인해 개인정보에 대한 다양한 방향에서의 효용가치가 높아지고 있다.
개인정보의 보호를 지나치게 강조하게 되면 효율적인 개인정보의 이용이 저해되고, 반대로 개인정보의무분별한 이용을 허용하게 되면 개인정보의 보호를 소홀히 하게 되어 궁극적으로 국민들의 개인정보자기결정권을 해치게 된다. 따라서 개인정보의 보호와 효율적인 활용이 조화롭고 적정하게 입법되어야 한다.
향후 빅데이터산업은 사물인터넷･클라우드 컴퓨팅 산업 등과 함께 정보통신산업의 성장을 이끌 한 축으로서 성장 가능성이 높다. 하지만 국내에서는 개인정보 보호와 관련된 규제의 경직성으로 인하여 많은기업들이 빅데이터 사업에 적극적으로 나서지 못하는 상황이다. 이렇게 국내의 현행 개인정보보호 관련법은 세계적으로 유래 없이 매우 높은 수준으로 개인정보의 보호를 강조하고 있어 빅데이터시대에 부합하는 방향으로 개정하는 것이 시급한 과제이다.
정보통신의 발달과 함께 정보의 자유로운 유통으로 인해 발생하는 개인정보 유출로 인한 피해는 막아야 한다. 반면, 향후 빅데이터에 의한 방식 등 개인정보의 활용도 중요하므로 개인정보의 보호와 활용이균형을 이루도록 관련 법제를 개선해야 한다.

영어초록

Futurists believe that the following three variables will determine the future of humanity: (1) the 4th industrial revolution derived from the development of information and communication technology(ICT) and artificial intelligence(AI); (2) demographic change resulting from the rapid declination of the young and old population; and (3) rapid natural environmental change resulting from global warming, and etc. They also mention that the 4th industrial revolution will have the most visible effect on economic development and job creation in the future.
According to the “4th Industrial Revolution” theory, advocated by the chairman of the World Economic Forum(WEF), Klaus Schwab in January 2016, the convergence of technologies and industries has caused fundamental changes in the industrial structure following the first industrial revolution(mechanization) which resulted from the invention of the steam engine, the second industrial revolution in regards to electricity(mass-production) and the third industrial revolution represented by IT technology(informatization and automation).
However, digital information increases rapidly in the information society and the accumulation and analysis of information become possible in a short period of time, which has produced many problems. One of the most problematic issue is privacy.
The problem of privacy in the information society is becoming a huge issue since the damages done by information leakage are continuing, and the losses of the state and individuals resulting from misuse and abuse of information and excessive information circulation are increasing exponentially.
As a result of the arrival of the Big Brother era, computer functions can be incorporated into anything, through which information related to individuals is collected and analyzed in real time, allowing everything related to people to be managed and supervised at any time, at any place. Sensitive personal information is disclosed to others unknowingly(e.g. theft of personal information), and the information collected, whether they are legal or illegal, is more likely to be disadvantageous to individuals. As a result, the number of legislative requests to prevent the risk is also increasing proportionately.
In addition, the big data industry is likely to grow as the axis that leads the growth of the information and communication industry in conjunction with the internet of things, and cloud computing industries also develops. However, due to the rigid regulations related to the protection of privacy in Korea, many companies cannot actively engage in the big data business.
Today, the importance of privacy is increasing not only in terms of privacy protection right, which is the basic human right of the information, but also in terms of information asset. Nevertheless, the Privacy Protection Act of Korea has high degree of privacy protection regulations compared to the global standard, but some systems, such as prior agreement, are criticized for being excessively strict and suppressing the development of new industries.
Since, with the development of information and communication, information is freely circulated and private information is continuously leaked, consequential damages caused by it should be prevented from spreading. On the other hand, related legislation should be also improved as to balance the protection and utilization of privacy by creating new added value, providing valuable information and sharing it with big data in the future.
