조선 전기 상속법 논의를 통해 본 부모의 위상 (The status of parents in the early half period of Joseon, examined through the inheritance law discussion)

본 논문에서는 조선 전기 증여ㆍ상속에 관한 법의 제정과 상속 분쟁의 판결을 위한 논의과정에 나타난 부모의 재산 처분권 존중 논리를 살펴봄으로써 조선의 위정자들이 부모, 자녀 관계를 어떻게 위치지우려 하였는지를 밝히고자 하였다. 이는 유교적 가족윤리의 근간이라 할 수 있는 강상윤리가 조선 전기의 법 제정과 운용에 어떠한 방식으로 반영되었는지를 파악하는 작업이기도 하다.
15세기의 증여ㆍ상속에 관한 법 제정과 운용 실태를 살펴보면, 부모의 재산 처분권 존중 원칙이 지속적으로 견지되었음을 알 수 있다. 그리고 이 원칙은 부모의 처분이 다른 유교적 가족질서 정착을 위한 정책에 위배되는 경우에도 지켜졌다. 이는 부모는 자애롭지 않더라도 자식은 효를 다해야 한다는 논리에 근거한 것이었다. 즉, 조선 전기의 위정자들은 부모, 자녀간의 상호적 관계보다는 자녀가 부모에게 순종해야 한다는 점에 초점을 맞추어 법을 제정하고 운용하였던 것이다.
이렇게 조선 전기의 위정자들은 가족내에서 부모의 권위가 절대적으로 존중되어야 한다는 이념을 증여ㆍ상속에 관한 법의 제정과 운영을 통해 구현하였다. 이러한 이념은 재산을 증여하거나 상속하는 과정에서 개인들의 의식과 생활에 투영되어 권위와 효로 상징되는 전통적인 부모, 자녀 관계 형성에 영향을 미쳤을 것으로 판단된다.

영어초록

Examined in this article, is the argument of respecting the parents' right to dispose their own properties, which was reflected in several legal processes such as the enactment of a law regarding donation & inheritance in Joseon's early half period, and also mirrored in the official discussions over inheritance issues & conflicts that led to public rulings in courts. The objective of this examination is to determine how the leaders of the Joseon dynasty defined the parent-offspring relationship, in legal terms. This could be the task of determining how the moral principles of hierarchy, which served as the basis for the dynasty's Confucian familial morals as well, was realized in the enactment and applications of law, during the dynasty's early years.
Enactment of a donation & inheritance law in the 15th century, and the application of such law, reveal that the principle of respecting the parents' right to dispose their own properties was steadily maintained. This principle was upheld even when the parents' decision to dispose something clashed with other policies that meant to encourage the establishment of a Confucian familial order in the country. And that was because of an argument that dictated even in cases that the parents were not benevolent, the sons and daughters should devote themselves to filial piety. In other words, the leaders of the early Joseon period enacted and applied laws based upon an argument that the offsprings should obey their parents, instead of pursuing a commutative relationship.
As we can see, the leaders of the early Joseon period established their philosophy which dictated that the authority of the parents should be absolutely respected and secured inside the family, through the enactment and applications of the donation & inheritance law. This kind of philosophy should have affected the individuals' consciousness and lives, in cases of property donations or inheritance, and it should have also been instrumental in the establishment of a traditional parent-offspring relationship in Joseon, represented by concepts like authority and filial piety.
