남북한의 경제교류와 법적 과제 (Inter-Korean Exchange and the Legal Challenge)

초록

북한은 2011년 말과 2012년 초 김정일 사망시 우리 정부의 조문태도를 구실로 지난 정부와 대화를 거부하였다. 우리 정부도 천안함, 연평도 사건을 계기로 강력한 5.24조치를 취하였으며 현재도 본 조치는 유효한 상태이다.
남과 북은 2013년 7월 6일부터 8월 14일까지 3개월 만에 개성공단 문제를 해결하기 위한 7차례의 당국 실무회담을 진행하고, 개성공단의 발전적 정상화를 위하여 3통 문제에 관하여 다음과 같이 합의하였다.
“남과 북은 개성공단을 왕래하는 남측 인원들의 신변안전을 보장하고, 기업들의 투자자산을 보호하며, 통행·통신·통관 문제를 해결한다.”(합의문 제2조). “남과 북은 통행·통신·통관 문제를 해결하기 위해, 당면하여 상시적 통행 보장, 인터넷 통신과 이동전화 통신 보장, 통관 절차 간소화와 통관 시간 단축 등의 조치를 취하기로 하고 이와 관련한 실무적 문제들은 「개성공단 남북공동위원회」에서 협의한다.”(합의문 제2조 제3항). 이번 합의 내용이 실질적인 조치로 이어졌을 경우에 남북 간의 경제교류를 위해 큰 의미를 지닌 조치라고 평가받을 수 있을 것이다.
그러나 이러한 우여곡절 끝에 개성공단의 재개되었음에도 불구하고 남북 간의 협력 사업은 더 이상 진전되지 못하고 있다. 하지만 향후 북한의 대내외적 환경 변화와 함께 남북 간의 경제교류협력이 재개되고 나아가 더욱 확대될 경우는 물론 평화적 통일로 전진하게 될 경우에 대비해 남북한 경협제도에 대한 사전적 연구와 분석을 통한 체계적이고도 종합적인 방안 마련이 절실하다. 또한 북한은 경제적 불안정, 탈북자 등 내적으로 동요와 변화가 나타나고 있고, 외적으로 국제사회의 고립 등 여러 변수에 따라 변화가 예견되는 만큼 우리는 이러한 정황에 상응하는 경제교류협력과 통일을 위한 종합적인 인프라가 구축되어야 할 것이다.
다만 현재의 남북의 냉각국면에서 경제교류와 협력이 활성화되기는 불가능하다. 현 정부의 대북정책인 ‘한반도신뢰프로세스’를 실행할 수 있는 전제조건인 ‘북한의 변화’가 가시화되지 못하고 있는 현실과 경제적 측면 보다는 정치적인 측면이 우선시되는 남북 간의 경제교류의 특성상 불가피한 부분이다.
따라서 본 연구에서는 현재 남북 간에 이루어지고 있는 경제교류 협력실태와 제도상 문제점과 개선안을 점검하여, 앞으로 경제교류협력의 효율성을 극대화할 수 있는 방안을 검토하고자 한다.

영어초록

North Korea rejected to continue inter-Korean talks on the pretext of South Korean government’s attitude over the death of Kim Jong-il from the end of 2011 to early in 2012. South Korea also imposed the May 24 measures after the attack on the naval ship Cheonan and Yeonpyeong Island, and the measure is still effective.
The South and North Korean authorities hold working-level talks seven times within three months—between July 6 to August 14 in 2013—to address the impasse over the Gaeseong industrial zone and agreed on three issues for the development and normalization of the park as follows.
“The South and North Korean governments will secure the safety of South Koreans who visit the Gaeseong industrial zone, protect the investments of businesses, and the three issues—access, telecommuni- cations, and customs.” (Agreement Art.2) “The South and North Korean governments will take measures, such as a guarantee of year-round passage, a guarantee of internet services and mobile telephone communication services, simplification of the customs process, and shorter customs clearance time, in order to resolve the three issues above. And the South-North Joint Committee will discuss practical matters.” (Agreement Art.2 Sec.3) If this agreement would lead to practical measures, it could be considered as a highly significant step for economic cooperation between the South and North.
Still, despite the rough reopening of Gaeseong industrial zone, there is no progress in the inter-Korean cooperation project. However, if the internal/external circumstances change in North Korea, it will be able to resume the project, even lead to peaceful unification on the Korean peninsula. In preparation for that, we need to come up with a compre- hensive and systematic plan through advanced studies and analyses of inter-Korean economic cooperation system. Also, we already know North Korea has been suffered from some internal issues, such as economic instability, increasing defectors, and etc. and external issues like the isolation in international affairs. It is easily anticipated that those variables will bring changes within North Korea. Therefore we need to build a comprehensive infrastructure so that we can prepare for further inter-Korean economic cooperation and exchange and, ultimately, for the unification.
However, currently it is hard to invigorate the economic cooperation and exchange due to the deadlock in inter-Korean relation, considering the situation where the present government is pursuing the trust- building process on the premise of real change in North Korea and usually politics trumps economics in the relations between the South and North.
Therefore, this study will examine the current status of inter-Korean economic cooperation and exchange, the problems and improvements of the system, and how to maximize efficiency of inter-Korean economic cooperation and exchange.
