기반시설관리운영권의 법적 쟁점 (Legal Issues on the Rights to Manage and Operate the Infrastructure)

초록

‘기반시설관리운영권’은 법률의 규정에 따라 창설된 물권(物權)으로, 시설관리권 또는 관리운영권 등의 명칭을 사용하며 대부분 유사한 조문체계를 구성하고 있다. 그러나 각각의 시설이 갖는 특성에 따라 그 운영방식에서는 차이를 보인다.
‘기반시설관리운영권’은 크게 두 가지로 다시 분류할 수 있다.
첫 번째는, 국가 또는 지방자치단체가 민영화의 한 단계로 공사 등에 출자하기 위해 설정하는 시설관리권이다. 수도시설관리권, 농업기반시설관리권 등이 이에 해당한다.
두 번째는, ‘민간자본을 유치하여 건설하는 SOC 시설에 설정’하는 시설관리권 또는 관리운영권이다. 항만시설관리권, 유료도로관리권, 사회기반시설 관리운영권 등이 여기에 해당한다.
대부분의 기반시설관리운영권 관련 규정에서는 “성질”을 규정하면서, “물권(物權)으로 보며, 해당 법에 특별한 규정이 있는 경우를 제외하고는 「민법」 중 부동산에 관한 규정을 준용한다.”고 공통적으로 기술하고 있지만, 해당 권리의 특징이 무엇인지, 어떻게 활용할 것인지에 대한 구체적인 고민은 담겨있지 않다. 단순히 부동산에 관한 규정을 준용한다고 할 것이 아니라, 권리의 속성에 대한 구체적인 고민과 검토를 한 후에 규정화했어야 하는 것은 아닌가 하는 아쉬움이 있다.
‘기반시설관리운영권’이 도입된 지 30년이 다 되어가는 현재에도, 물권으로서의 기반시설관리운영권의 특성 및 기능이 무엇인지에 대한 논의가 많지 않다. 그렇지만 ‘기반시설관리운영권’의 체계적인 연구를 통해 그 활용 확대 방안을 모색한다면 민간투자를 통한 사회기반시설의 설치, 유지, 관리에 다방면으로 기여할 수 있을 것으로 기대한다.
이후, 새로운 형태의 ‘물권(物權)’으로서의 기반시설관리운영권의 법적 성질, 공법적 권리로서의 새로운 재산권의 내용, 부동산 관련 규정의 준용 타당성 여부, 기반시설관리운영권 설정에 따른 유지·관리의무의 범위, 기반시설관리운영권자의 법적 지위 등에 대한 구체적이고 체계적인 연구가 필요하다.

영어초록

The ‘rights to manage and operate the infrastructure) is the real right that is established in accordance with relevant legislation. The rights are called as right of facilities management or right to manage and operate and contents of laws providing those rights are similar to each other. However,
there are differences in operation methods of each facilities depending on characteristics of facilities.
The first is the facility management right which is established by the state or local government to invest in construction, as a step of privatization. The facility management right includes the right to manage water facilities and the right to manage agricultural infrastructure.
The second is the facility management right or the right to manage and operate that is ‘created in social overhead capital which is constructed with private capital.’ Rights to manage port facility management right, rights to manage toll road, and rights to manage and operate infrastructure are included.
Most provisions on the rights to manage and operate infrastructure stipulated “nature” and regards the rights as “real rights. They also state that provisions on the real property in the civil act shall apply mutatis mutandis unless there are special provisions in the law.” Nonetheless, those provisions are not clear about what the characteristics of the rights are and the way to use them. The legislation on the rights to manage and operate facilities should be enacted after through consideration and review on the nature of rights rather than only state ‘apply mutatis mutandis.’
Almost 3 decades has passed since the ‘rights to manage and operate infrastructure’ was introduced, however, characteristics and functions of the rights to manage and operate as a real rights have not been clearly defined. In addition, the rights are not well exercised in society. If we try to find ways to utilize and expand them through well organized and systematic research and studies, the rights could be used for numerous purposes, for example, creating, managing, and maintaining infrastructure.
This study reviews ‘the rights to manage and operate infrastructure’ provided in Korean law over the past 30 years. In fact, there are not many preceding research or studies on the issue to refer, it is hard to thoroughly analyze the rights in a short period of time. To figure out issue mentioned above, like defining characteristics and nature of the rights and ways to use them, research and studies should be conducted in the near future.
