국제 사이버 산업스파이: 국제법적 대응을 중심으로 (Transnational Cyber Industrial Espionage: The Responses of International Law)

초록

오늘날 사이버 활동은 더욱 사회 기능의 중심이 되어 가고 있다. ICT 및 사이버 기반산업 구조의 변화와 맞물려 영업 비밀과 기타 데이터를 절취하기 위해 기업이나 정부 시스템을 해킹하거나 바이러스로 공격하는 사이버 산업스파이 행위가 전례 없이 급증하고 있다.
국제 사이버 산업스파이에 대한 효과적 대응을 위해서 국제사회는 먼저 사이버 산업스파이가 기업과 국가의 경제이익 및 국제 자유무역 질서에 대한 심각한 위협이 된다는 점을인식해야 안다. 국제 사이버 공간에서 영업비밀 등 지식재산의 탈취를 금지하는 국제법의개발은 더욱 안정적인 국제 경제질서 구축에 이바지할 것이다. 특히, 경제 안보로 뒷받침되는 장기적 경제적 번영을 확보할 수 있는 반 사이버 산업스파이의 세계적 국제법 질서를합의하기 위하여 국가들이 그 편협하고 국수적 이익에 얽매이어서는 안 된다.
국제 사이버 산업스파이 사례, 피해, 위험이 급증하는 상황에서 국제사회는 신속하게 현재 미흡한 국제법상 예방과 처벌, 국제책임 제도를 혁신하여야 한다.
먼저 글로벌 조약으로서 가칭 ‘국제 사이버 산업스파이 협약(Convention on International Cyber Industrial Espionage)’의 제정을 제안한다. 동 협약으로 ① 국제 사이버 산업 스파이 행위에 대한 통일적이고 구체적인 정의(定義), ② 국가의 행위로서 또는 국가가 후원하는 국제 사이버 산업스파이 금지에 대한 국제의무의 설정, ③ 국제 사이버 산업스파이에 대한 국제관습법상 불간섭 원칙과 영토 책임 및 due diligence의 내용과 적용 범위를 구체적으로 규정, ④ 2001년 사이버 범죄 협약과 같이 당사국에게 비국가행위자에 의한 국제 사이버 산업스파이를 방지, 처벌하는 데 필요한 국내법 입법 의무 부과, 그리고 ⑤ 심각한 국제 사이버 산업스파이 등 사이버 범죄의 처벌에 대한 국가의 보편주의 관할권을 인정하여 범죄와 관련성이 없는 당사국도 사법관할권을 행사할 수 있도록 해야 한다.
국제 사이버 산업스파이의 처벌을 위한 보편주의 관할권 원칙의 인정은 사이버 영역의국가 영토와의 관련성이 희박하다는 점과 처벌의 국제적 실효성 확보를 위해 필요하다. 물론 사이버 공간과 연결을 위한 기반 시설이 영토 내에 존재하는 당사국은 영토관할권을 확장하여 국내법에 따라 사이버 산업스파이를 처벌할 수 있다고 판단된다.
피해국의 국제책임법상 대응조치가 효과적으로 발동될 수 있도록 그 발동요건, 수단, 범위를 국제 사이버 산업스파이 행위의 특성에 적합하도록 구체화할 필요가 있다. 또한, 대응조치의 남용을 방지하는 기준도 필요하다. 국제 사이버 산업스파이에 의한 외국의 영업비밀 탈취 행위를 WTO 회원국의 영토 내에서 방지해야 할 의무를 구체적으로 명확하게 규정하는 방식으로 TRIPs 협정을 보완해야 한다.

영어초록

Today, cyber activity is becoming more and more central to social functioning. In line with changes in the ICT and cyber-based industrial structure, cyber industrial espionage, which involves hacking corporate and government systems or attacking them with viruses in order to steal trade secrets and other data, is increasing at an unprecedented rate.
In order to effectively respond to international cyber industrial espionage, the international community must first recognize that cyber industrial espionage poses a serious threat to the economic interests of companies and countries and the international free trade system. The development of an international law prohibiting the theft of intellectual property, including trade secrets, in international cyber space will contribute to the establishment of a more stable international economic order. In particular, in order to agree on a global international legal order of anti-cyber industrial espionage that can secure long-term economic prosperity supported by economic security, states should not be bound by their narrow national interests.
In a situation where cases, damages, and risks of international cyber-industrial espionage are rapidly increasing, the international community must promptly innovate the currently insufficient prevention and punishment system and international responsibility rules under international law.
First, this paper proposes the adoption of the ‘Convention on International Cyber Industrial Espionage’ as a global treaty that stipulates the following; ① Uniform and specific definition of international cyber industrial espionage; ② Prohibition of state or state-sponsored international cyber industrial espionage as an international obligation; ③ The contents and scope of application of rules under customary international law, such as the principle of non-interference, territorial responsibility, and due diligence, are specifically stipulated in relation to international cyber-industrial espionage; ④ States parties are obliged to legislate domestic laws to prevent and punish international cyberindustrial espionage by non-state actors; and ⑤ Regulates the universal jurisdiction of the state for the punishment of cyber crimes such as serious international cyber industrial espionage.
Recognition of the principle of universal jurisdiction for the punishment of international cyber industrial espionage is necessary in order to ensure the international effectiveness of the punishment given that the cyber domain has little relevance to national territories. Of course, it is judged that a State party whose infrastructure for connection to cyberspace exists within its territory can expand its territorial jurisdiction and punish cyber industrial espionage according to its domestic law.
It is necessary to specify the triggering conditions, means, and scope to suit the characteristics of international cyber-industrial espionage so that the victim state can effectively trigger countermeasures under the international liability rules. In addition, standards to prevent abuse of countermeasures should be established.
The TRIPs Agreement needs to be supplemented in a way that specifically and clearly stipulates the obligation to prevent foreign trade secret theft by international cyber industrial espionage within the territory of a WTO member state.
