제4차 산업혁명 시대의 망중립성에 관한 규범적 고찰 (A Normative Study on the Network Neutrality in the Era of 4th Industrial Revolution)

초록

망중립성(Network Neutrality)이란 보통 통신사 등 인터넷서비스사업자(ISP)가 특정 콘텐츠나 인터넷 기업을 차별·차단하는 것을 금지하는 정책을 말한다. 이 원칙에 의하면 인터넷서비스사업자는 이용자에게 망을 개방하여 자유로운 인터넷 접속이 가능하도록 하고 이용자를 차별하거나 차단하지 않으며, 합리적이고 투명한 방법으로 네트워크를 관리하여야 한다. 하지만 빅데이터, 인공지능, 사물인터넷 및 5G 네트워크 등으로 대표되는 4차 산업혁명은 다양한 지능정보형 서비스의 출현과 이를 둘러싼 방송 통신 생태계 변화를 초래하고 있다. 이러한 변화는 기존의 망중립성 원칙에 대한 새로운 검토를 요구하고 있다. 미국 오바마 행정부는 오픈인터넷규칙(Open Internet Regulation)을 발표하여 차단금지, 차별금지, 우선전송금지 등 망중립성 원칙을 규정하였다. 그렇지만 지난 2017년 12월 14일 트럼프 행정부는 오바마 행정부에서 발표한 오픈인터넷규칙을 인터넷자유회복이라는 기치 아래 폐기하였다. 이에 따라 ISP는 통신사업자가 아닌 정보사업자로 분류되어, 차단금지, 차별금지, 대가에 따른 우선전송 금지 등의 의무를 부담하지 않게 되었다. 최근 트럼프 행정부에서는 이러한 망중립성 의무를 폐기하기로 결정하였다. 트럼프 행정부의 망중립성 원칙 폐기는 미국 우선주의(America First) 정책과 상통한다. 트럼프 정부는 망중립성 원칙을 폐기함으로써 노동집약적 성격이 강한 망 사업을 활성화하여 경기를 부양시키고자 하고 있다. 우리나라도 망중립성과 관련하여 그동안 지속적으로 규제 체계를 정비하여 왔다. 즉 「망중립성 인터넷 트래픽 관리에 관한 가이드라인」과 「통신망의 합리적 트래픽 관리‧이용과 트래픽 관리의 투명성에 관한 기준」이 시행되고 있다. 그렇지만 이 가이드라인과 기준은 법적 구속력이 없다는 한계가 있다. 망중립성 논의는 인터넷 망의 중립적 운영과 관련한 원칙을 설정하는 것 뿐만 아니라 이용자의 보호는 물론 망에 대한 투자재원, 인터넷망 상호접속, 망 개방 등을 아우르는 매우 포괄적인 문제이다. 그런데 최근 방송통신시장에서의 시장지배력은 인터넷서비스사업자(ISP, Internet Service Provider)에서 플랫폼사업자로 이동하고 있고 이에 따라, ISP에 의한 경쟁제한 행위의 가능성도 함께 감소하고 있다. 따라서 네트워크 시장의 성숙기에 경쟁 활성화와 소비자 후생 증진을 위한 취지로 도입이 모색되었던 망중립성에 대한 규제는 신중하게 검토되어야 한다.

Policy that prohibits Internet neutrality (Network Neutrality) and Internet service providers (ISPs) such as regular carriers from discriminating against or blocking specific contents or Internet companies. According to this principle, the Internet service provider have to open the network to the user so that free Internet connection can be made. And discriminates and blocks users must be managed in the network in a reasonable and transparent way It must be.However, the 4th industrial revolution is represented by big data, artificial intelligence, the Internet's Internet and 5 G network, etc. has brought about the emergence of various intelligent information type services and changes in the broadcast communication ecosystem surrounding. These changes are seeking a new study of the neutrality principle of the existing net.The US Obama Administration Department prohibits blocking the Open Internet Regulation, announced by the Obama administration on December 14, 2017. As a result, the ISP is classified as an information provider, not a telecommunications carrier, so as not to bear the obligation of block prohibition, prohibition of discrimination, prohibition of priority transmission according to consideration.Recently in the trump regime, we decided to abandon such net neutrality obligation. Abandonment of the neutrality principle of the net of the Trump regime is equal to the American First Priority (America First) policy. By discarding the principle of network neneutrality, the cardigan government is trying to revive the economy by revitalizing network business with its strong labor intensive character.Korea has also maintained a regulatory system on a continuous basis in connection with the neutrality of the net. The "guidelines on net neutrality Internet traffic management" and "the rational traffic management of the network ‧ the criteria on the transparency of usage and traffic management" are enforced. However, these guidelines and standards have limitations that they are not legally binding.The neutrality argument covers not only the principle on the neutral management of the Internet network but also the protection of users, the investment resources in the network, the interconnection on the Internet network, the opening of the network, etc.. Very comprehensive problem, however, the market power in the broadcast communication market has moved from the Internet service provider (ISP, Internet Service Provider) to the platform operator, and accordingly the possibility of restraining competition by the ISP is also decreasing . Therefore, regulations on the neutrality of the net, which the introduction had requested for the purpose of revitalizing competition and promoting consumer welfare during maturity of the network market should be.
