재판상 화해의 기판력과 창설적 효력 (Res Judicata and Creative Effect of Judicial Compromise)

초록

이 글은 재판상 화해의 기판력과 창설적 효력의 내용과 상호관계에 대하여 분석한다. 재판상 화해의 성질론으로는 사법행위설, 소송행위설, 양성설, 병존설 등이 있는데, 병존설이 사실적인 차원에서 실상에 부합하고, 그러한 실상에 따라 실체법적 행위와 소송법적 행위를 분리하여 고찰할 수 있게 해주기 때문에 타당하다. 대법원 판례가 소송행위설을 취하고 있다고 알려져 있지만, 실제로는 병존설을 취하고 있다고 보는 것이 타당하다. 병존설에 따르면 재판상 화해는 소송행위 부분과 사법행위 부분으로 구성되고, 이들은 각 절차법과 실체법의 적용을 받는다. 기판력은 소송행위 부분에서 발생하고, 창설적 효력은 사법행위 부분인 민법의 화해에서 발생한다. 재판상 화해의 기판력은 확정판결의 기판력과 같은 것이므로, 그 성격은 실체법적 권리관계와 무관한 소송법적 효력이고, 객관적, 주관적 범위, 시간적 범위 내에서만 작용한다. 특히 공격방어방법에 대한 기판력의 차단효는 재판상 화해로 장래의 급부의무에 기판력이 생긴 경우에도 표준시인 조서작성시를 기준으로 작용한다. 재판상 화해의 경우, 확정판결과 달리, 창설적 효력에 의하여 실체법적 권리관계가 변동되기 때문에 조서작성 이후의 사정변경에 기한 주장은 기판력에 의하여 차단되지는 않지만, 창설적 효력 때문에 배척될 수도 있다. 재판상 화해의 기판력은, 확정판결의 기판력과 달리, 소송물인 권리관계 이외의 다른 권리관계나 제3자의 권리관계에도 발생할 수 있으나, 화해조항에 기재된 사항 전부가 아니라, 예상되는 특정 분쟁(소송)의 주문/청구취지에 상응하는 부분에만 한정하여 발생한다고 보는 것이 타당하다.

영어초록

This paper analyzes the content of and interrelationship between res judicata and creative effect of judicial compromise. Among the theories regarding the legal nature of judicial compromise, the coexistence theory is most appropriate as it corresponds to the factual reality and enables separate examination of substantive law acts and procedural law acts. While the Supreme Court is commonly believed to adopt the procedural act theory, it is more reasonable to interpret that the Court actually follows the coexistence theory. According to the coexistence theory, judicial compromise consists of both procedural and substantive law acts, each governed by procedural law and substantive law respectively. Res judicata arises from the procedural act component, while the creative effect stems from the substantive law component, civil compromise under the Civil Code. Since the res judicata of judicial compromise is equivalent to that of a final judgment, it is a procedural effect, independent of substantive legal relationships, operating only within its objective, subjective, and temporal scope. Notably, the preclusive effect of res judicata on means of attack and defense operates based on the standard time, which in judicial compromise is the time of protocol preparation, even when judicial compromise creates res judicata for future obligations. Unlike final judgments, in judicial compromise, while claims based on changed circumstances after protocol preparation are not precluded by res judicata, they may be rejected due to the creative effect as the substantive legal relationship is altered by such effect. Unlike the res judicata of final judgments, the res judicata of judicial compromise may extend to legal relationships beyond the subject matter of litigation or to third-party rights. However, it is reasonable to conclude that res judicata does not apply to all matters stated in the compromise provisions but is limited to those portions corresponding to the anticipated litigation's judicial disposition or prayer for relief.
