초록

안면인식(Face Recognition) 기술은 열적외선 촬영, 3차원 측정, 골격 분석 등을 통해 얼굴 형태나 열상(Thermal Image)을 스캔·저장·인식하는 기술로, 카메라에 잡힌 얼굴 이미지와 저장된 사진 DB를 비교하여 신원을 확인하는 데 활용된다. 얼굴인식 기술은 정확성이 높고 신속하게 사람을 식별할 수 있어 신원확인, 출입통제 등 다양한 분야에서 널리 활용되고 있다. 안면인식기술의 발전은 CCTV, 사물인터넷(IoT), 광범위한 네트워크 열결망과 결합하여 상시적 감시체계의 도래와 이에 따른 프라이버시의 붕괴라는 디스토피아(dystopia)적 우려를 현실화한다. 또한 편향된 안명인식기술은 소수자를 비롯한 소수집단의 권리와 자유를 침해하는 차별의 도구로 악용될 수도 있다. 2023년 국가인권위원회는 얼굴인식 기술로 인한 인권 침해에 관한 의견을 표명하여 국회의장과 국무총리에게 적극적 대응을 권고했다. 공공장소에 있는 사람의 얼굴을 국가가 직접 들여다보는 것이 시민들의 자유로운 활동을 위축시키고 부당한 감시 체계로 이어질 수 있다는 것이다. 얼굴 인식 기술 등 생체정보는 그 특수성으로 인하여 다른 개인정보보다 유출 및 오·남용시 파급효과가 더 크고 특히, 공개적인 공간에서 불특정 다수를 대상으로 한 실시간 안면인식 기술은 상대방의 동의없이 무단으로 안면인식기술을 통하여 타인의 행적과 정보를 수집하는 것이 초상권과 자기정보결정권을 침해하는 것은 아닌지 문제부터 사생활의 비밀과 자유 집회, 결사의 자유 등 기본권침해에 대한 우려가 큰 상황이다. 또한 실시간 안면인식 치안시스템은 개인정보 보호와 사생활 침해라는 문제를 가지고 있다. 따라서 수집된 얼굴 데이터의 보안과 해킹 위협에 대한 대책, 얼굴 데이터베이스의 안전한 관리 등도 심도 있게 검토되어야 한다.
본 연구에서는 안면인식기술 규제에 관한 주요 국가의 입법 동향을 살펴보고, 안면인식기술의 안전한 활용을 위한 개인정보 보호 방안을 모색하고자 한다.

영어초록

Face recognition technology is a method that utilizes thermal infrared photography, three-dimensional measurement, and skeletal analysis to scan, store, and recognize facial shapes or thermal images. It verifies identity by comparing facial images captured by cameras with those in a stored photo database. This technology is extensively applied in various sectors, such as identity verification and access control, due to its high accuracy and quick identification capabilities.
The advancement of facial recognition technology, coupled with CCTV, the Internet of Things (IoT), and widespread network connections, is materializing dystopian fears concerning omnipresent surveillance and the ensuing erosion of privacy. Additionally, biased facial recognition technology may serve as a tool for discrimination, infringing upon the rights and freedoms of minorities and other marginalized groups.
In 2023, the National Human Rights Commission of The Republic of Korea issued a statement regarding human rights violations facilitated by facial recognition technology and urged the Speaker of the National Assembly and the Prime Minister to actively respond. The statement highlighted that direct observation of individuals' faces in public spaces by the state could limit citizens' freedom of movement and lead to unwarranted surveillance.
Given the unique nature of biometric information, such as facial recognition technology, the repercussions of data breaches and misuse are more severe compared to other types of personal information. Specifically, real-time facial recognition technology that targets an unspecified number of individuals in public spaces without their consent may infringe upon the right to privacy and informational self-determination, as well as other fundamental rights including privacy, freedom of assembly, and freedom of association. Furthermore, real-time facial recognition security systems pose challenges in terms of privacy protection and invasion. Hence, the security of collected facial data, defenses against hacking threats, and the secure management of facial databases require thorough examination.
This study explores the legal framework and international legislative trends related to biometric information, including facial recognition technology, to identify measures for protecting personal information and ensuring the safe use of this technology.
