초록

최근, 18대 국회 및 학계 그리고 각종 단체에서 개헌논의가 활발히 진행 중이다. 뿐만 아니라 최근 EU 등 OECD제국에서는 지방분권형 국가운영체제로 국가 운영방식을 전환하고자 지방분권정책을 확대 도입하고 있으며, 심지어는 이를 위하여 헌법마저도 개정하고 있는 추세이다.
이에 최근 제기되는 헌법개정 논의를 주요 학회와 기관을 중심으로 살펴본 결과 권력구조 특히 정부형태의 논의에 집중되어 있었다. 즉 국가권력간의 수평적 권력배분에 관하여는 논의가 많지만, 국가경쟁력을 좌우하는 중앙-지방간의 권한배분인 수직적 권력배분에 대하여는 논의가 매우 빈약하였다.
본고에서는 현행 헌법상 사무배분의 실태와 문제점을 지적하고 헌법에 반영하여야 할 사무배분 관련 사항과 헌법이 어떠한 방향으로 개정되어야 할 것인지에 대한 대안을 제시하였다.
이를 위해 이탈리아, 독일, 대만의 헌법에서 중앙-지방간 사무를 어떻게 배분하고 있는 지를 비교법적으로 살펴보았다.

영어초록

Given the fact that the member states of the European Union and the OECD have long promoted decentralization policies by furthering the amendment of their Constitutions, the Korean constitutional amendment has been also actively discussed in the 18th National Assembly’s sessions, together with in the milieu of academia and various organizations concerned.
Upon that fact, this paper aims firstly to review the recent discussions on political and constitutional revision about the decentralization in Korea, that are focused mainly on the power structure, especially structural reform of government system; that means the fact that the constitutional revision has been discussed mostly on the horizontal distribution of political and administrative tasks, but rarely mentioned about the vertical distribution of powers in government system. The vertical division of responsibilities in this article means that the possible transfer of powers from central to provincial or regional government must be made in the course of decentralization process, especially because of enhancing the national competitiveness through the transfer of political and administrative authorities between the level of governments.
Secondly, for that purpose, this paper suggests to closely look at the conditions and problems embedded in the practices based upon the current Korean constitutional provisions in the field of task division between the central and local government, in comparison with the various advanced countries’ constitutional experiences in decentralization such as Italy, Germany and Formosa.
In the conclusion, this article tried to lay some fundamental principles on the vertical division of powers between the level of governments in the era of decentralization, which must be guaranteed and written in the constitutional provisions on the occasion of the constitutional amendment discussions in National Assembly.
