Abstract

초록

평균 수명의 연장은 노인 인구 비율의 급증을 초래해서 고령화로 인한 사회 문제가 날로 심각해지고 있다. 이러한 고령화는 교정에서도 노인수용자의 증가를 가져오고 있으며 이들에 대한 처우가 주요한 교정현안으로 대두되고 있다.
또한 형사사법체계에서 노인에 대한 관심 부재는 ‘숨겨진 노인차별의 한 형태’로 나타나고 있다. 이러한 무관심은 상대적으로 노인수용자의 비율이 적다는 것에서 원인을 찾을 수도 있다. 그러나 교정 분야에서 노인수용자의 증가에도 불구하고 크게 주목 받지 못하고 있다. 최근에서야 노인수용자에 대한 다양한 관점에서의 연구가 시작되면서, 과거 교정 정책과 활동에서 거의 발견하지 못한 노인수용자들이 경험 할 수 있는 여러 문제들이 밝혀지고 있다. 이러한 드러난 여러 문제 중에 특히 노인수용자들이 교도소 환경 내에서 젊은 수형자들과 다른 고유한 문제를 겪고 있으며, 이로 인해 처우나 석방, 재통합 문제가 원만하지 못 하다는 것이 드러나고 있다. 예를 들어 많은 노인수용자들이 교도소 구금으로 받을 수 있는 강한 심리적 충격, 친구나 가족과 관계 단절과 그로 인한 불안감, 건강 관련 문제, 노인에 적합한 교정 처우 프로그램 부재 등이다. 특히 장기간 형기를 복역한 노인수용자는 강한 시설화(institutionalisation) 부정적 효과를 경험할 수 있는데, 이는 석방 시 사회복귀를 위한 기본적인 요소들이 결여될 수 있 다는 것을 확인 할 수 있다. 이 글은 늘어나는 노인수용자 인구와 최근 전체범죄에서 노인범죄가 구성하고 있는 분석을 통해 노인수용자에 대한 개념 정리와 현황을 살펴보고 재통합모델에 관한 요소를 검토하였다. 특히 노인수용자 문제에 대한 미국과 영국의 경험을 중심으로 재통합 프로그램을 집어본 후 우리형편에 맞는 실질적인 대책을 모색할 수 있도록 하였다. 이에 따라 첫째, 사회 재적응 문제에 초점을 둔 구금시설 대체프로그램의 도입, 둘째, 노인수용자에게 지역사회 적응과 재범을 줄여주는 역할을 위한 주거지원 프로그램, 셋째, 사회재진입 프로그램, 마지막으로, 형사사법체계에서 노인수용자의 소외감을 줄이고, 사회 화와 지역사회 지지를 높이는 데 힘쓰기 위한 형사사법체계에서 노인층의 사회 복지서비스 프로그램 도입을 제시했다.

영어초록

As the prolonged average length of life has caused a rapid increase in the ratio of the aged population, the social problem resulted from the aging has been worse every day. This aging has brought about the increase in the elderly in a correction field and the treatment toward the elderly has been the main correctional issue of the society.
In addition, the absence of a interest in the elderly in the criminal justice system has appeared in "a form of the hidden discrimination to the elderly". the main reason of this indifference can be found in that the ratio of the elderly inmate is comparatively low. But, the elderly has not yet got any attention in spite of the increase in the number of the elderly inmate. Only recently, as the research on the elderly inmate has started from various angles, many problems that the elderly inmate can experience, which was not discovered in the previous correctional policies and activities have been disclosed. Among these disclosed problems, It comes out that the elderly have their own distinctive problems different from the young one and the problems like the treatment, the release, and reintegration are not amicable. For example, there are the strong psychological shock that the elderly inmate can receive due to the imprisonment, the severance of relations with his/her friends or family and the derived anxiety, the health problem, and the absence of the correctional treatment problem suitable for the elderly. especially, the elderly who served his sentence for a long time can experience the negative effect of the strong institutionalization. It identifies that there is a lack of the basic factors helpful for the rehabilitation on a release.
This study examined the concepts and the present condition related to the elderly inmate, and the factors of the re-integrated model by analyzing the increasing population of the elderly inmate and the factors of composing the crime by the elderly out of the recent whole crime. Especially, this study points out the program for the reintegration through the experiences of America and England related to the problems of the elderly inmates and then seeks the practical measures suitable for our conditions. Accordingly, this study suggests five programs for the welfare of the elderly inmates as follows: first, the introduction of the substitute program focused on the problem of a rehabilitation; second, the program of the housing policy that can help the elderly inmate to adjust to the community and reduce a second conviction; third, the program of reentering a society; and the last, the introduction of social welfare service program for the elderly in the criminal justice system that makes efforts to reduce a sense of alienation of the elderly and increase the socialization and the support of the community.
