초록

노무현대통령의 참여정부가 등장하면서 핵심 정책과제에 ‘참여복지와 삶의 질 향상’과 더불어 ‘지방분권과 국가균형발전’을 제시하고 있고 지방분권은 현재 최대의 정책이슈이자 사회복지의 제반영역에도 영향을 미칠 것으로 예상되고 있다. 이에 따라 본 논문은 정부간 복지행정 기능배분의 특성과 체계를 파악하며, 한국 복지행정 기능배분의 현실과 문제점을 분석하고, 복지분권의 방향과 정책적 과제를 제시하고자 한다. 분권의 구체적 내용은 정부간 기능의 배분으로 나타나며 정부의 기능배분은 주로 사무의 배분을 중심으로 나타난다. 우리나라 정부의 사무는 국가직접처리사무, 기관위임사무, 단체위임사무, 자치사무로 구분이 가능하다. 공공부문, 민간부문, 제3섹터에서 각각 서비스가 이루어지는 사회복지 중에서 공공사회복지행정은 접근성, 지역특성, 주민참여, 보호위주의 행정이라는 특성을 각각 갖는다. 지방자치가 재개되면서 지방이양합동심의회와 지방이양추진위원회에서 사무의 이양을 추진하여 왔으나 사무이양의 실적은 극히 미미하였고 지방자치단체에 권한이 없는 중앙집권주의적 경향, 권한없는 사무배분체계, 사무구분의 모호성 등의 문제를 안고 있는 것으로 나타났다. 사회복지의 정부간 기능배분 실태를 보건복지부의 사회복지 관련업무를 중심으로 살펴 본 결과 자치사무의 비중이 낮아 복지행정의 중앙집권성이 높고, 사무간 역할구분이 명확하지 못하며, 지역조장적 성격이 취약하고, 지역고유사무라 하더라도 기획조정적 사무가 미약한 것으로 나타났다. 지방분권은 외부의 제약으로부터의 자율성인 제1유형과 지역내부의 제약요인으로부터의 자율성인 제2유형이 모두 중요한데 사회복지영역에서도 양 유형 모두의 진전이 필요하며 이를 위해 대폭적인 업무의 하향 이양과 지역주민중심으로의 업무의 단순화, 지역사회 각 주체가 연계되도록 복지거버넌스의 심화가 필요할 것으로 제시하였다.

영어초록

The Roh's government called ‘Participatory-Government’ is putting much significance on the ‘Local Autonomy and Balanced National Development' as well as 'Participatory welfare and the Improvement of the Quality of Life'. Especially the local autonomy is considered the hottest policy issue and expected to affect on the general areas of social welfare. Based on this trend, this thesis is focused on understanding the characteristics and the system of function allocations in the inter governmental social welfare public administration. Suggesting the desirable ways of the decentralization of social welfare services, it also analyze the reality and problems of the allocations in Korean social welfare public administration. The specific contents of the decentralization are manifested into the inter-governmental allocation of functions. And the inter-governmental functions allocations are manifested into the allocations of the affairs. The Korean governmental Affairs are usually divided into the four parts -- the central government affairs, the delegated-organization's affairs, the delegated-local government's affairs, and the local government's affairs. The social welfare services are provided in the three major sectors. They are public, private and the third sectors. Among the services, the public social welfare administration has some features such as accessibility, localities, and residents' participation, care-centered administration. Although the reopening of the local autonomy is making some progress in delegating the affairs by the delegation committee and the delegation commission, their achievement is not only very limited but also include many problems. The problems are the centralization of less local autonomy, the allocation of less power, and the obscure affair dividing. Making its focus on the social welfare related affairs in the Ministry of Health and Welfare, the results of researching the reality of inter-governmental allocation of administration functions in social welfare shows the facts. One of them is the high centralization due to the less amount of local government affairs. Second, the lines in dividing affairs are rather ambiguous. Third, it fails to promote the local development. Last but no least, even the local governmental affairs, themselves, are of less planning and coordination. The local autonomy has two types. One of them is autonomy from the external limitations and the other is autonomy from the local limitations. Both of them are important factors in the local autonomy. Also, they should be developed together in the field of social welfare autonomy. There are some essential points for the development of them: the drastic delegation of affairs to the low-level, the making affairs focused on the local residents conveniences, and the expansion of the social welfare governance making the proper network among the local subjects.
