1929년 월가의 주식폭락으로 시작된 대공황은 미국사회 전반에 엄청난 변화를 불러왔다. 미국의 근본적인 가치관을 형성했던 개인주의에 대한 의문이 제기되었고, 경제에 대한 국가개입의 필요성이 인정되었다. 1932년 대통령에 당선된 프랭클린 D. 루즈벨트(Franklin D. Roosevelt)의 첫 번째 과제도 공황극복이었으며, 그는 이를 위해 뉴딜(New Deal)이라 불리는 일련의 정책을 실시하였다.
뉴딜의 이론적 기초는 과소소비론이었다. 과도한 경쟁이 이루어지는 시장에서 개개의 자본가는 경쟁력을 유지하기 위해 가격을 낮추어야 한다. 가격경쟁을 위한 노력은 임금삭감 혹은 정리해고로 이어지고, 노동자들은 점점 가난해져 구매력을 상실하게 된다. 결국 소비가 생산을 따라잡지 못하게 되고, 이 때문에 공황이 발생한다는 것이 과소소비론의 내용이었다. 따라서 뉴딜은 과소소비의 해결을 위해 과잉 경쟁의 완화와 공정 거래에 초점을 두었다.
흔히 ‘뉴딜 노동법’으로 불리우는 전국산업부흥법(National Industrial Recovery Act : NIRA)의 7(a)조와 이를 계승한 와그너법(Robert F. Wagner가 제정한 전국노동관계법 National Labor Relations Act : NLRA의 별칭) 역시 이러한 과소소비론의 기초 위에서 노동과 자본의 불평등 완화를 목적으로 제정되었다. 전국산업부흥법의 7(a)조는 노동자의 단결권과 단체교섭권을 인정하였으며, 와그너법은 이러한 단결권과 단체교섭권의 실효성을 확보하기 위해 사용자의 부당노동행위를 규제하고 노동자의 단체행동권을 인정하였다.
그러나 와그너법을 단순히 뉴딜정책의 일환으로만 이해하는 것은 한계가 있다. 와그너법은 루즈벨트 정부가 아닌 상원의원 와그너에 의해 주도되었고, 정부는 와그너법 제정과정에 소극적인 태도로 일관했다. 루즈벨트의 뉴딜이 산업전반의 협조와 지지를 목표로 한 반면, 와그너법은 자본의 반대와 노동의 지지 속에서 제정되었다. 따라서 와그너법의 제정은 루즈벨트가 실시한 일련의 뉴딜정책과는 다소 다른 배경에서 비롯된 것으로 이해해야 할 것이다.
