메타버스 공간에서의 기본권 보호와 플랫폼 규제에 관한 시론적 연구 (An Introductory Study on the Protection of Fundamental Rights and Platform Regulation in Metaverse)

초록

코로나19 팬데믹으로 오프라인 활동의 일부가 온라인으로 옮겨가면서 세미나, 의료실습, 교육, 공연 등 현장감이 필요한 행사들이 메타버스에서 행해지고 있다. 최근에는 5G, AR, VR, XR, AI 등 컴퓨팅 기술이 메타버스 혁신을 가져옴에 따라 메타버스 플랫폼 규제에 대한 논의도 본격화될 것으로 보인다.
지금까지 가상공간에 대한 규제는 인터넷 공간에 광범위하게 적용되어왔다. 게임, 상거래, 포털 등 각종 인터넷 기반 플랫폼에 대한 규제가 바로 그것이다. 가령 게임, 상거래, 포털 등 각종 플랫폼에 적용되는 「전기통신사업법」, 「정보통신망 이용촉진 및 정보보호 등에 관한 법률」, 「전자상거래 등에서의 소비자보호에 관한 법률」 및 「게임산업진흥에 관한 법률」 등 관련 법률은 플랫폼사업자에 대해서 적잖은 의무사항을 지우고 있다. 이와 관련해서 국내에서는 최근 EU와 미국에서 제안된 플랫폼 규제법들을 도입하려는 움직임이 있지만, 플랫폼에 대한 규제는 참여자의 기본권에 대한 제한을 수반한다. 메타버스는 인간이 아바타를 조정해 거주, 집회, 오락, 경제 활동을 자유롭게 할 수 있어야 하는 공간으로 다양한 이용자의 창조적 참여를 통해 발전되는 특징이 있다. 따라서 메타버스 공간에 기존의 인터넷 규제체제를 성급히 적용할 것이 아니라, 플랫폼상 일반적 행동의 자유 및 개별적 기본권의 보호에 입각한 보장체계를 마련할 필요가 있다.
이 글은 이러한 문제의식에서 본격적인 메타버스 시대를 앞두고 헌법 10조가 보장하는 인간존엄 및 행복추구권에 입각한 기본권 보장의 방향을 탐구한 결과, 다음의 결론에 이르렀다. 첫째, 메타버스 플랫품은 인간의 현실세계에서의 다양한 일상이 구현되는 변화무쌍한 공간으로 일반적 자유권인 행복추구권과 자유로운 인격권의 보호를 중심으로 규율되어야 한다. 둘째, 메타버스 공간은 다양한 성격을 지닌 공간으로, 개별 플랫폼의 성격, 현실세계와의 상호작용의 정도, 영향력을 고려한 규율이 필요하다. 셋째, 메타버스 공간은 일반적인 행동의 자유가 실현되는 공간이므로 자유권적 기본권이 특별히 보호될 필요가 있다. 다만 메타버스 플랫폼의 유형 및 충돌되는 기본권의 중요도에 따른 이익형량이 필요하다. 넷째, 메타버스에는 일정한 세계관과 질서가 존재한다. 바로 창조성과 자유가 발휘되어야 할 공간인 만큼 구성원의 합의에서 비롯된 자율규제가 핵심이 되어야 하며, 국가 역할은 플랫폼 참여자의 자유로운 경쟁을 보장하는 환경 마련에 집중되어야 할 것이다.

영어초록

As some of the offline activities have moved online due to the COVID-19 Pandemic, events that require a sense of realism such as seminars, medical practice, education, and performances are being held on Metaverse. Recently, discussions on metaverse platform regulations are expected to begin as metaverse innovation is expected thanks to computing technologies such as 5G, AR, XR, VR, and AI. Until now, regulations on virtual space have been widely applied to Internet space. It is the regulation on various Internet-based platforms such as games, commerce, and portals. For example, 「the Telecommunications Business Act」, 「the Act on Promotion of Information and Communication Network Utilization and Information Protection」, 「the Act on Consumer Protection in Electronic Commerce」, and 「the Game Industry Promotion Act」 imposes a number of obligations on platform operators. On the one hand, there is a movement by domestic regulators to introduce recently proposed platform regulation laws in the EU and the United States, and regulations on these platforms involve restrictions on participants' fundamental rights. Metaverse is a space where humans can control their avatars to freely engage in residence, assembly, entertainment, and economic activities, and is characterized by development through the participation of many operators. Therefore, before hastily applying the existing Internet regulation system to the metaverse space, it will be said that the priority is to establish a guarantee system based on the protection of general freedom of action and individual fundamental rights on the platform.
This article came to the following conclusion as a result of seeking the direction of guaranteeing fundamental rights based on the right to pursue human dignity and right to pursue happiness guaranteed by Article 10 of the Constitution ahead of the full-fledged metaverse era. First, the metaverse platform is a ever-changing space where various daily lives in the real world of humans are embodied, and should be regulated around the protection of the general right to pursue happiness and free personal rights. Second, the metaverse space is a space with various characteristics, and discipline is needed in consideration of the nature of individual platforms, the degree of interaction with the real world, and influence. Third, the metaverse space is a space where general freedom of action is realized, so fundamental rights of freedom need to be specially protected. However, it is necessary to sentence profits according to the type of metaverse platform and the importance of conflicting fundamental rights. Fourth, there is a certain worldview and order in the metaverse. In other words, as it is a virtual space where creativity and freedom should be exercised, self-regulation arising from the agreement of members should be the key, and the role of the state should focus on preparing an environment that guarantees free competition among platform participants.
